Real Estate Agenda Update for Tuesday Feb 26th 2008

-ON BEHALF OF COUNCIL PRESIDENT LESNICK AND COUNCILWOMAN MCDOW—

Please be advised that the Real Estate Meeting scheduled for Tuesday, February 26 is expected to be extremely brief for the following reasons:

(Item 1) We had reserved space to discuss the Demolition Review Ordinance; however we are still circulating language changes. In addition Councilman Murtagh, a sponsor of the legislation will be unavailable at that time.

(Item 2) There is no opposition to the long house sewer connection at 393 Fox Avenue by the local councilman and no one else on the Council, so we will vote this item on.

(Item 3) We had reserved space for an update on the review of the SFC Project by the Lead Agency. The City Council's consultants have been reviewing the re-submitted Preliminary Draft Environmental Impact Statement (pDEIS) that SFC delivered on February 5, 2008. The review is to determine whether the revised document adequately addressed the Council's October 22, 2007 review which contained 460+ comments on the initial submission. The current review is to determine whether the pDEIS is complete and adequate to commence its public review. At this time, the Council's review indicates that there are numerous open issues that need further detailing, and the Council has instructed its consultants to immediately meet with SFC's consulting team to review these open items so that the pDEIS can be deemed complete and ready for public review. The SFC consultant team has agreed to meet with the Council's consultants beginning on Wednesday morning, February 27. The Council's consultants will brief the Real Estate Committee next Tuesday, March 4th on its progress.

4. Home Rule Request for Bill A3171 to provide for the payment of the salary, wages, medical and hospital expenses of any City of Yonkers detention officer injured or becoming ill in the line of duty.

5. Home Rule Request for Bill A8499 to authorize the City of Yonkers to discontinue the use of certain lands as Parkland and sell and convey such land.

6. Home Rule Request for Bill A6781 to authorize the department of transportation to establish speed limits of less than 30 miles per hour in the City of Yonkers upon the receipt of a resolution passed by the city council and signed by the mayor of such city.

7. Home Rule Request for Bill A6410 to authorize the City of Yonkers to establish one or more transportation improvement districts to improve transportation in certain critical areas of the city.

FINALE SCORE: TWO NIL Published in Westchester Times Tribune This Week

FINALE SCORE: TWO NIL by Martin McGloin

On Monday morning feb 4th I was given a second bout of good news. With the New
York Giants scraping by to what was an unexpected defeat of the undefeatable
Patriots, I could hardly believe the news. Delivered in electronic form by Jeff
Buss an Attorney with Smith, Buss Jacob in Yonkers, at 8:16 am he informed the community of Yonkers plaintiffs that they also won what often seems a victory that is unattainable. We beat City Hall. We didn’t hit the crossbar we tore a hole in the onion bag, with a penalty Kick. The Cities Goalie Kevin Plunkett did not have a chance.

As extra time played it was hard to know if we would end up with penalty kicks
deciding our legal fate and future. That was not to be. The referee blew the
final whistle. The Supreme Court of the State of New York Appellate Division:
Second Department ruled in favor of those brave community members and some of
our local politicians who dared stand up to Yonkers own Tammany Hall. The
cheers of the crowd could be felt and heard all around Yonkers as the good news spread like wildfire, by phone, computer and voice. You can beat City Hall, You can beat City Hall was the heartfelt message. A Hallmark love story for valentines day came early.

The 3 to 1 decision, decided on January 29th 2008 by the Judges brought me back
to a place in the memory banks of my mind of my visit to the court back in September of 07. Justice Crane, Florio and Carni ruled in our favor. Judge Lifson ruled with the City. Reading the Decision and Order made me feel like I was on American Idol
and all but Simon wanted me to go to Hollywood. Judge Lifson played Simon on
this show. Lifson dissented and gave a long winded and 5 page explanation of what
transpired. He was the videotape judge and I guess our last piece de
resistance.

It was a long and tiring game. We had no substitutes but we lost two players in
the second half. Council President Lesnick and Councilwoman Annabi left the
field with injuries.
These injuries were self inflicted, as Lesnick once elected did everything to
play a mediator role and worked hard to promote solutions to the community
which to this day are still not palatable He called it a charette we all called it
a charade To this day I hear he is calling for a regatta on Sprain Lake, but nobody wants it, especially all those adjacent to the lake.
Wanna buy the Brooklyn Bridge, No thanks!

Sandi Annabi was the last off the field and she played gallantly
until the week before the council voted and she just didn’t have the stamina
for this game.On July 11th 2006 the council voted for a second time
to approve the Ridge Hill project by supermajority vote.Not only did she leave the field she changed jerseys and came back on the field playing for the other side.
Interesting enough the cities tape of this meeting required by the FBI, has never surfaced. My version will remain on YonkersTV forever.

One has to ask how much this has cost the taxpayer of Yonkers. Is this
arrogance Supreme? or is the Amicone administration protecting all of us?
Who makes these decisions? Is it by committee or by the Emperor?

The most important aspect of this decision was that we took on City Hall and
won. Ordinary residents of Yonkers New York's 4th largest City, said enough was enough when a Majority of the Council, 2 Councils ago under then Council President
Richard Martinelli changed the rules, kicked the referee off the field and
played ball according to their own rules. The community who had watched and
respected and followed the process would not be fouled. A brave group of
community members and local politicians stood up for the rights of all of the
residents of Yonkers and headed straight to court.

So the final score is Community 2, City of Yonkers 0. Now the City could appeal
the decision but they would be foolish, wouldn't they ?

That portion of Marco Avenue, located in the easterly side of this street, between Smart Avenue and Cerrone Avenue, as shown on a map and description filed with the Planning Board of the City of Yonkers, is a public street in the City of Yonkers, is hereby discontinued as a public street and removed from the Official Map of the City of Yonkers, in its entirety pursuant to Section 29 of the General City Law.

Permission is hereby granted to the property owner of 48 THE CROSSWAY, Block 5481 Lot(s) 26 to make a long house sanitary sewer connection from said lot to a city sanitary sewer in THE CROSSWAY at his own cost and expense and in accordance with the plan submitted by BRUNO PIETROSANTI R.A #020574 dated NOVEMBER 26,2007 filed in the Plumbing Division, subject to the conditions of a Plumbing Permit to be secured from the Plumbing Division and a street opening permit to be secured from the City Engineer.




Section 2. This permission is granted under the following terms and conditions, to wit:

SIXTEEN CITY-OWNED LOTS ALONG WARBURTON AVENUE AS PARKLAND


WHEREAS, in January 2006 Mayor Phil Amicone announced an Urban Green Space Initiative outlining a series of “green space” related goals for the City of Yonkers; and


WHEREAS, the following items were included among these important goals:


* Reclaiming nearly 25 acres from within the Struever Fidelco Cappelli development plan as public park space;
* Opening the Hudson River waterfront between the Ludlow Train Station and the Kennedy Marina;
* Daylighting sections of the Saw Mill River / Nepperhan Creek;
* Creating a river walk esplanade running through the Nepperhan Valley into downtown Yonkers --- thus transforming Larkin Plaza into a large and open public space; and
* Renovating, restoring and creating new and better park/playground facilities at locations that include Kardash Park, Wakefield Park, Fleming Field, Bregano Park, Scotti Park, Sullivan Oval and “Boo” Wilson Park; and




WHEREAS, in addition to meeting the specifics of the goals outlined in the Urban Green Space Initiative, wherever available and appropriate it is important for the City to preserve other parcels of land forevermore by making additions to our Park System’s inventory of open space; and


WHEREAS, in keeping with and furtherance of this initiative, the Mayor seeks to preserve and dedicate sixteen (16) parcels of land running along the westerly or easterly sides of Warburton Avenue between Harriman Avenue and Otis Park; and

WHEREAS, although due to their topography, these parcels have limited use in the traditional open space/parkland sense, they serve a purpose which is undeniably worthy of their permanent preservation; and

RESOLUTION

12. BY COUNCIL PRESIDENT LESNICK, MAJORITY LEADER ANNABI, MINORITY LEADER McLAUGHLIN, COUNCILMEMBERS McDOW, GRONOWSKI, MURTAGH AND BARBATO:

WHEREAS, the authorization for the City of Yonkers to negotiate the private sale of its bonds and notes is vital to improving the City’s financial stability and independence, and
WHEREAS, the continuance of this power will allow more cost-effective financing of the City’s debt, and
WHEREAS, the City’s bonding authority will expire on June 30, 2008 unless it is extended one year, and
WHEREAS, Senate Bill No. S.6878 and its companion bill, Assembly Bill No. A09887 have been introduced into the New York State legislature, and
WHEREAS, these bills will permit the private sale of bonds or notes by the City of Yonkers, subject to the approval of the State Comptroller, and
NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Yonkers hereby declares that the enactment of S.6878 and AO.9887 are in the best interests of the City and is essential to improving the city’s financial stability and independence, and
BE IT FURTHER RESOLVED, that the City Council requests the City Clerk to forward a copy of this Home Rule Request Message to the Legislature of the State of New York requesting the passage of the aforesaid bills.

13. BY COUNCIL PRESIDENT LESNICK, MAJORITY LEADER ANNABI, MINORITY LEADER McLAUGHLIN, COUNCILMEMBERS McDOW, GRONOWSKI, MURTAGH AND BARBATO:

BE IT RESOLVED that the Yonkers City Council hereby renews the professional services contract for the accounting firm of Bennett Kielson Storch DeSantis & Company LLP, One Barker Avenue, White Plains, New York 10601 to conduct the annual independent audits of the City of Yonkers finances for the Fiscal Years ending June 30, 2008; June 30, 2009; June 30, 2010; June 30, 2011; and June 30, 2012.

14. BY COUNCILMEMBER McDOW, COUNCIL PRESIDENT LESNICK, MAJORITY LEADER ANNABI, MINORITY LEADER McLAUGHLIN, COUNCILMEMBERS, GRONOWSKI, MURTAGH AND BARBATO:

WHEREAS, the City of Yonkers is blessed to work with unions who not only support and promote job security and better wages for their members, but that also generously contribute their time and resources to great causes, and

WHEREAS, one such union is LOCAL 456 INTERNATIONAL BROTHERHOOD OF TEAMSTERS, which last year partnered with Municipal Housing Authority Senior Centers to provide Thanksgiving dinners to the seniors of our City, and

WHEREAS, this past Thanksgiving, LOCAL 456 was able to give nearly 900 baskets to individuals who would not otherwise had any celebration, and

WHEREAS, the City of Yonkers is grateful to LOCAL 456 for their generosity on Thanksgiving and throughout the year.

NOW, IT IS THEREFORE RESOLVED, that the City of Yonkers hereby commends and congratulates President Eddie Doyle and members of LOCAL 456 INTERNATIONAL BROTHERHOOD OF TEAMSTERS for providing Thanksgiving donations in 2007 and for their continued service to the City of Yonkers and its residents.

RESOLUTION

15. BY COUNCIL MEMBER GRONOWSKI, COUNCIL PRESIDENT LESNICK, MAJORITY LEADER ANNABI, MINORITY LEADER McLAUGHLIN, COUNCILMEMBERS McDOW, MURTAGH AND BARBATO:

WHEREAS, Lake Avenue Merchants would like to honor the 2008 Grand Marshall, Michael Morley who will be leading the 53rd Yonkers Saint Patrick’s Day Parade on March 2, 2008. To honor the new Grand Marshall the Lake Avenue Merchants, have requested permission from the City Council to place a banner in an area promoting this event, and
WHEREAS, Lake Avenue Merchants have asked that they be permitted to place one (1) banner on Lake Avenue nearest to Morley’s Restaurant & Bar in the area towards Lennon Park, on or around February 14, 2008 and to be removed as soon after March 18, 2008 as is possible.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Yonkers hereby grants permission to Lake Avenue Merchants to place one banner in the aforementioned location, subject to any terms and conditions deemed appropriate by the Administration to protect the best interests of the City of Yonkers.

RESOLUTION
16. BY COUNCIL PRESIDENT LESNICK, MAJORITY LEADER ANNABI, MINORITY LEADER McLAUGHLIN, COUNCILMEMBERS McDOW, GRONOWSKI, MURTAGH AND BARBATO:

WHEREAS, Our Lady of Fatima School, located at 963 Scarsdale Road in Yonkers, New York will hold its annual Penny Social on Friday, May 9, 2008, and has requested permission from the City Council to place two banners in the area promoting this event, and WHEREAS, Our Lady of Fatima School has asked that they be
permitted to place two (2) banners at the location of Central Park Ave. & Sadore Lane, on the pedestrian over-pass, or where ever convenient in that same area on Central Park Ave., on or about April 8th and to be removed as soon after May 9, 2008 as is possible.
NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of Yonkers hereby grants permission to Our Lady of Fatima School to place two banners in the aforementioned location, subject to any terms and conditions deemed appropriate by the Administration to protect the best interests of the City of Yonkers.
