Notice is hereby given that the City Council of the City of Yonkers, N.Y. will hold a Public Hearing on Tuesday May 5, 2009 at 8:00 P.M. in the City Council Chambers, City Hall, Yonkers N.Y. on the following matter to wit:
In accordance with the provisions of Section 505(3) of Article 15 of the General Municipal Law of the State of New York, as amended, the City Council will hold a public hearing to consider approval of the proposed Alexander Street Urban Renewal Plan (the “Urban Renewal Plan”). The City Council approved and authorized the designated area for the Urban Renewal Plan (the “Alexander Street Urban Renewal Area”) by Resolution No. 8-2005 adopted on January 11, 2005 in accordance with Section 504 of Article 15 of the General Municipal Law and directed the Yonkers Community Development Agency (the “Agency”) to prepare an urban renewal plan for the Alexander Street Urban Renewal Area.
At the Public Hearing, the City Council will also consider approval of the proposed master plan for the Urban Renewal Plan (the “Master Plan”) and the Brownfield Opportunity Area Plan (“BOA”) for the Alexander Street Urban Renewal Area. The BOA Program is a New York State program designed to provide communities with assistance to complete revitalization plans and implementation strategies for areas affected by the presence of brownfield sites, vacant and underutilized sites (the Urban Renewal Plan, the Master Plan and the BOA Plan are hereinafter collectively referred to as the “Alexander Street Plans”).
Following completion of coordinated review procedures under the New York State Environmental Quality Review Act (Article 8 of the Environmental Conservation Law of the State of New York) and the regulations issued thereunder by the Commissioner of Environmental Conservation of New York State (6 NYCRR Part 617) (such Act and regulations being hereinbelow referred to as “SEQRA”), the Agency designated itself as lead agency for the environmental review of the Alexander Street Plans. The Agency completed the SEQRA process, and adopted the SEQRA Findings Statement for the Alexander Street Plans on November 20, 2008, and submitted the Alexander Street Plans to the Planning Board of the City of Yonkers (“Planning Board”). The City Council is the approving agency for the Alexander Street Plans and, as a result, must also adopt a findings statement under SEQRA prior to any approval of the Alexander Street Plans by the City Council.
The Planning Board, after a public hearing held on due notice, found that the Urban Renewal Plan is in compliance with the requirements of Section 505(2) of Article 15 of the General Municipal Law, and unqualifiedly approved the Alexander Street Plans in all respects for submission to the City Council.
A copy of the proposed Alexander Street Plans is available for public examination at the office of the Agency, 87 Nepperhan Avenue, Yonkers, New York for a period of ten (10) days commencing on the date of publication of this Notice, between the hours of 9:00 a.m. and 4:00 p.m., Monday through Friday.

In accordance with the provisions of Section 505(3) of Article 15 of the General Municipal Law of the State of New York, as amended (hereinafter referred to as “Article 15 GML”), and Section 28-a of Article 3 of the General City Law, the City Council will hold a public hearing to consider approval of proposed modifications of two urban renewal plans known as the Getty Square Urban Renewal Plan and the Modified Urban Renewal Plan for N.D.P. Areas No. 1 and No. 2 (the “Urban Renewal Plans”) and for certain amendments to the Yonkers Downtown Waterfront Master Plan (the “Downtown Waterfront Master Plan”).
On May 17, 2006, the Yonkers Community Development Agency (the “Agency”) approved Struever Fidelco Cappelli, LLC (“SFC”) as an eligible and approved sponsor of certain projects in the Getty Square Urban Renewal Area and the Riverview Urban Renewal Area (also known as N.D.P. Areas No. 1 and No. 2) (the “Redevelopment Projects”) and the projects require certain amendments to the Urban Renewal Plans and the Downtown Waterfront Master Plan (the “Plan Modifications”).
Following completion of coordinated review procedures under the New York State Environmental Quality Review Act (Article 8 of the Environmental Conservation Law of the State of New York) and the regulations issued thereunder by the Commissioner of Environmental Conservation of New York State (6 NYCRR Part 617) (such Act and regulations being hereinbelow referred to as “SEQRA”), the City Council of the City of Yonkers designated itself as lead agency for the environmental review of the Redevelopment Projects including the Plan Modifications. The City Council completed the SEQRA process, and adopted the SEQRA Findings Statement for the Redevelopment Projects and the Plan Modifications on November 5, 2008.
The Agency requested the Planning Board of the City of Yonkers (the “Planning Board”) to initiate procedures, in accordance with but not limited to Section 505 of Article 15 GML, to evaluate the proposed Plan Modifications, and after a public hearing held on due notice by the Planning Board on March 11, 2009 and after due deliberation during a Special Meeting held on March 25, 2009, the Planning Board adopted resolutions unqualifiedly approving the Plan Modifications for submission to the City Council and recommended the adoption of the Plan Modifications to the Urban Renewal Plans without amendment and the Downtown Waterfront Master Plan.
A copy of the SEQRA Findings Statement, the Plan Modifications and the Urban Renewal Plans are available for public examination at the office of the Agency, 87 Nepperhan Avenue, Yonkers, New York for a period of ten (10) days commencing on the date of publication of this Notice, between the hours of 9:00 a.m. and 4:00 p.m., Monday through Friday.
