The City of Yonkers hereby ordains and enacts:
Section 1: The City’s Grant Budget for fiscal year 2008/2009 is
hereby amended by increasing revenues and appropriations for the Fire
Department for a grant from NYS Homeland Security Office for the
purchase supplies and expenditures of Overtime to prepare for
catastrophic events.

RESOLUTION
3. BY COUNCIL PRESIDENT LESNICK, MAJORITY LEADER ANNABI,
MINORITY LEADER McLAUGHLIN, COUNCILMEMBERS McDOW,
GRONOWSKI, MURTAGH AND BARBATO:
WHEREAS, the New York State Office of Homeland Security, has
awarded the City of Yonkers an Urban Area Security Initiative (UASI)
Grant, in the amount of 2 million dollars ($2,000,000), in order to enhance
its ability to respond to acts of terrorism and plan for catastrophic training
and equipment; and
WHEREAS, the term of this UASI grant is from July 1, 2007 until
June 30, 2010, with no matching funds provided by the City of Yonkers;
and
WHEREAS, the Mayor of the City of Yonkers is hereby authorized
to execute such agreement with the New York State Office of Homeland
Security, for a term of July 1, 2007 to June 30, 2010, in order to provide
such funds to the Fire Department of the City of Yonkers;
NOW, THEREFORE BE IT RESOLVED, that the Mayor of the City
of Yonkers is hereby authorized to execute the UASI grant agreement with
New York State Office of Homeland Security, for the purchase of
equipment and the planning and training of the Yonkers Fire Departments
to respond to acts of terrorism, with the total amount of the award at
$2,000,000; and be it further
RESOLVED, that this resolution shall take effect immediately.

BE IT RESOLVED, by the Yonkers City Council, that August J.
Cambria, as Commissioner of the Department of Parks, Recreation and
Conservation, is hereby authorized to apply for and accept grant funds
from the New York State Office of Parks, Recreation and Historic
Preservation, in accordance with the provisions of the Recreation Trails
Program, to continue the restoration work in Untermyer Park’s Historic
Carriage Trail, the grant is in the amount of $200,000, with $40,000
coming from matching funds from the City of Yonkers, which would be
requested in next years CIP Budget; and be it further
RESOLVED, that this resolution shall take effect immediately.

plaintiffs against The City of Yonkers Police Department and Lt. Frank
Coriello, Defendants", for property damage arising out of an accident
alleging that his vehicle was damaged by a Yonkers police vehicle, be and
the same hereby is approved and the Comptroller of the City of Yonkers is
directed to draw his warrant in the amount of seven hundred and fifty

8. COUNCILMEMBER BARBATO; COUNCIL PRESIDENT LESNICK,
MAJORITY LEADER ANNABI, MINORITY LEADER McLAUGHLIN,
COUNCILMEMBERS McDOW, GRONOWSKI AND MURTAGH:
WHEREAS, for decades the City of Yonkers struggled to attract
potential developers to invest in our city, and
WHEREAS, was this no where more evident then in attempts to jump
start redevelopment and overall revitalization of our waterfront and downtown
area, and
WHEREAS, only in recent years have we seen a number of projects
moved from the drawing board to the approval process to fruition, and
WHEREAS, in order to spur on such development, the City
Administration acting through its Industrial Development Agency offered
prospective developers a number of significant benefits including, but not limited
to, very favorable Payment in Lieu of Taxes (PILOT) arrangements in
accordance with section 858(15) of the General Municipal Law, and
WHEREAS, while these PILOT arrangements may have been necessary
to spur on the initial private investment in the revitalization of our waterfront and
downtown areas, this may no longer be the case, and
WHEREAS, while PILOTS are not to be discounted as an important
development and redevelopment tool for any municipal government, it is
important that any PILOT be controlled so as not to 'give away the proverbial
store', most especially at a time when the potential for much needed new
revenue sources are so necessary to the fiscal health of our city; specifically, to
maintain city services and, especially, to add additional dollars to our already
cash strapped school system without further burdening our homeowners, and
WHEREAS, in addition to the financial burden created by these
developments there has also been an overwhelming amount of complaints
from tenants living in Federal, State and/or locally funded (YIDA, MHA,
HUD funded) buildings that have been made possible by PILOT
arrangements in regard to sub-standard living and maintenance conditions

WHEREAS, in many instances the developer/owner of the
property is enjoying the benefits of tax abatements and other monetary
benefits while failing to meet local code requirements, and putting the
health, safety and welfare of the occupants and the general public in
jeopardy,
WHEREAS, because the Local Municipal Legislative Body is
charged with approving and adopting the Municipality’s Budget and Tax
Roll it only makes sense to provide the Local Municipal Legislative Body
with the authority to determine the need for such incentives as well as the
Municipality’s actual ability to extend the same benefits to
developers/owners while maintaining fiscal accountability to the
Municipality’s citizens and taxpayers.
WHEREAS, in order to accomplish this important balance between
spurring on development and redevelopment and sound fiscal policy, a policy of
control in the hands of the local legislative body should be added to section
858(15) of the General Municipal Law as it pertains to the creation of the Local
Industrial Development Agency.
NOW, THEREFORE BE IT RESOLVED, by the City Council of the
City of Yonkers, hereby requests that section 858(15) of the General
Municipal Law be amended to include the following as it pertains to the
implementation of PILOT arrangements;
a) That the sum and substance of all future PILOT arrangements
including, but not limited to all terms and conditions, are to be approved by
a SEPARATE resolution of the Local Municipal Legislative Body;
b) That the Local Municipal Legislative Body be provided with full
justification for the need of the PILOT and its economic benefit, including
the rationale for such an agreement and the benchmarks to ensure that
we are realizing said benefit.
c) That all terms and agreements presented to the Local Municipal
Legislative Body include any and all other tax relief, incentives, or benefits
being sought by the beneficiary from any other level of government;

d) That the maximum term of any future PILOT arrangement shall be no
more than 10 years with any extension being voted on by the Local
Municipal Legislative Body;
e) That all future PILOT arrangements shall include a provision to
upwardly adjust the PILOT payments at least every 2 years at a rate that
is equal to an amount that is no less than the cumulative amount of the
rate of inflation during the proceeding period;
f) That all future PILOT arrangements must contain a provision which
negates the ability of the developer (or other beneficiary of the PILOT, or
successor in title or deed) from filing a tax certiorari during the entire life of
the PILOT arrangement, and;
g) In addition, the PILOT arrangement must also contain a provision by
which the developer (or other beneficiary of the PILOT, or successor in
title or deed) agrees that the 'look-back' period of any future tax certiorari
cannot go back into that time period during which the PILOT arrangement
was in effect; and be it further
h) That the Local Municipal Legislative Body will be allowed to establish the
conditions for these benefits/abatements and the ability to revoke such benefits if
the projects do not meet the established conditions;
BE IT FURTHER RESOLVED that the Yonkers City Clerk is
hereby directed to forward certified copies of this resolution to the Yonkers
delegation in the New York State Senate and Assembly.

WHEREAS, the City of Yonkers is proud of its many diverse
community groups who play an integral leadership role in preserving and
displaying the rich history of each community represented in our beautiful
mosaic of communities; and
WHEREAS, foremost among these groups is the St. Patrick’s Day
Parade Committee which spearheads the efforts each year to highlight the
notable achievements and contributions of prominent caring members of
the Irish-American Community; and
WHEREAS, the St. Patrick’s Day Parade originated in Yonkers at
the Irish Centre on November 29, 1955 and the first festive Parade
commemorating this annual celebration in Yonkers took place on Sunday
March 11, 1956; and
WHEREAS, each year the St. Patrick’s Day Parade Committee
hosts a series of events in our City, sharing its proud heritage with all our
residents, beginning with the “Changing of the Sash” in early February and
culminating with the festive St. Patrick’s Day Parade and dinner, this year
on the 8th day of March 2008 and will once again celebrate the history and
splendor of the Irish and those most supremely proud of their Irish-
American heritage; and
WHEREAS, these annual events provide opportunities for the
Committee to bestow well deserved honors upon outstanding members of
the community who have selflessly given of their time, expertise and
resources to promote the welfare and advancement of not only the Irish-
American Community but also that of our beloved Yonkers; and

WHEREAS, the New York State Office of Homeland Security, has
awarded the City of Yonkers an Urban Area Security Initiative (UASI)
Grant, in the amount of 2 million dollars ($2,000,000), in order to enhance
its ability to respond to acts of terrorism and plan for catastrophic training
and equipment; and
WHEREAS, the term of this UASI grant is from July 1, 2007 until
June 30, 2010, with no matching funds provided by the City of Yonkers;
and
WHEREAS, the Mayor of the City of Yonkers is hereby authorized
to execute such agreement with the New York State Office of Homeland
Security, for a term of July 1, 2007 to June 30, 2010, in order to provide
such funds to the Fire Department of the City of Yonkers;
NOW, THEREFORE BE IT RESOLVED, that the Mayor of the City
of Yonkers is hereby authorized to execute the UASI grant agreement with
New York State Office of Homeland Security, for the purchase of
equipment and the planning and training of the Yonkers Fire Departments
to respond to acts of terrorism, with the total amount of the award at
$2,000,000; and be it further

the PILOT arrangement, and;
g) In addition, the PILOT arrangement must also contain a provision by
which the developer (or other beneficiary of the PILOT, or successor in
title or deed) agrees that the 'look-back' period of any future tax certiorari
cannot go back into that time period during which the PILOT arrangement
was in effect; and be it further
h) That the Local Municipal Legislative Body will be allowed to establish the
conditions for these benefits/abatements and the ability to revoke such benefits if
the projects do not meet the established conditions;
BE IT FURTHER RESOLVED that the Yonkers City Clerk is

WHEREAS, the City of Yonkers is proud of its many diverse
community groups who play an integral leadership role in preserving and
displaying the rich history of each community represented in our beautiful
mosaic of communities; and
WHEREAS, foremost among these groups is the St. Patrick’s Day
Parade Committee which spearheads the efforts each year to highlight the
notable achievements and contributions of prominent caring members of
the Irish-American Community; and
WHEREAS, the St. Patrick’s Day Parade originated in Yonkers at
the Irish Centre on November 29, 1955 and the first festive Parade
commemorating this annual celebration in Yonkers took place on Sunday
March 11, 1956; and
WHEREAS, each year the St. Patrick’s Day Parade Committee
hosts a series of events in our City, sharing its proud heritage with all our
residents, beginning with the “Changing of the Sash” in early February and
culminating with the festive St. Patrick’s Day Parade and dinner, this year
on the 8th day of March 2008 and will once again celebrate the history and
splendor of the Irish and those most supremely proud of their Irish-
American heritage; and
WHEREAS, these annual events provide opportunities for the
Committee to bestow well deserved honors upon outstanding members of
the community who have selflessly given of their time, expertise and
resources to promote the welfare and advancement of not only the Irish-
American Community but also that of our beloved Yonkers; and

COUNTY TAXES, INCLUDING SEWER DISTRICT TAXES AND REFUSE
DISPOSAL DISTRICT TAXES, FOR THE CALENDAR YEAR 2009, AND
LEVYING AND ASSESSING THE TAXES CONTAINED THEREIN.
The City of Yonkers, in the City Council convened, hereby ordains
and enacts:
Section 1. The apportionment and extension of the assessment
roll of Westchester County Taxes for the calendar year 2009, including
sewer district taxes and refuse disposal district taxes, having been
completed by the City Assessor at the direction of the City Council, said
apportionment and extension constitutes the tax rolls for Westchester
County Taxes and said taxes are hereby levied and assessed on the real
property appearing thereon as therein set forth.
Section 2. The Mayor is authorized to sign and attach to such tax
rolls a warrant under the corporate seal of the City allowing the City
Comptroller to collect, in the manner provided by law, the taxes set forth
therein, and the City Assessor is hereby directed to deliver the said tax
rolls to the Comptroller.
Section 3. This ordinance shall take effect immediately.

AN ORDINANCE AUTHORIZING AND PERMITTING THE PROPERTY
OF 125 PARKVIEW AVE. BLOCK 5664 LOT (S) 7 TO MAKE A LONG
HOUSE CONNECTION TO THE CITY'S SANITARY SYSTEM IN
PARKVIEW AVE. (NO EXPENSE TO THE CITY OF YONKERS).
The City of Yonkers, in City Council convened, hereby ordains and
enacts:
Section 1. Permission is hereby granted to the property owner of
125 Parkview Ave., Block 5664 Lot(s) 7 to make a long house sanitary
sewer connection from said lot to a city sanitary sewer in Parkview Ave.
at his own cost and expense and in accordance with the plan submitted by
Eliot Senor, Professional Engineer #81627 dated March 28, 2008, filed in
the Plumbing Division, subject to the conditions of a Plumbing Permit to be
secured from the Plumbing Division and a street opening permit to be
secured from the City Engineer.
Section 2. This permission is granted under the following terms
and conditions, to wit:
The granting of this permission shall, in no way, free or release the
said owner, or his successors, from the payment of any assessments or
benefits accruing to said lot by reason of the construction of any sanitary
sewer already built, or that hereafter shall be built, to serve the area within
which the lot herein referred to is located.
The cost of construction, maintenance and repairs of said long
house connection shall be the responsibility of the owner of the building
served by the long house connection.

WHEREAS, private individuals and interested parties are seeking
to make monetary donations to assist in the development and
maintenance of a new City of Yonkers Animal Shelter facility, and it is
proposed that the City of Yonkers coordinate such donations to be used
for the public purpose of developing the City of Yonkers Animal Shelter
facility; and
WHEREAS, the current Yonkers Animal Shelter was designed for
animal control, and as presently constituted is undersized and improperly
equipped to allow for the adoption of healthy animals; and
WHEREAS, the a new Yonkers Animal Shelter facility would allow
for the adoption of healthy animals and decrease the current burden on
housing stray animals; and
WHEREAS, the Mayor and the City Council wish to assist in the
development of a new City of Yonkers Animal Shelter facility; and
WHEREAS, donations made to the City of Yonkers to assist in the
development of a City of Yonkers Animal Shelter facility further the public
purpose of the humane treatment of stray animals and enhance the quality
of life for residents of the City of Yonkers; therefore be it
RESOLVED, that the City Council of the City of Yonkers hereby
supports the creation of a special fund for donations to be used for the
development efforts of a new City of Yonkers Animal Shelter facility; and
be it further
RESOLVED, that the City Council requests that the Commissioner
of Finance and Management Services (the “Commissioner of Finance”) is
hereby directed to set up and manage the records of a separate account
entitled “City of Yonkers Animal Shelter Fund” to be funded solely by
private donations and to be used for expenses related to the development
of a new City of Yonkers Animal Shelter facility; and be it further
RESOLVED, that the Mayor is authorized to take whatever steps
necessary to effectuate this resolution; and be it further

A RESOLUTION AUTHORIZING THE IMPLEMENTATION AND
FUNDING OF THE FEDERAL AID AND STATE “MARCHISELLI”
PROGRAM-AID ELIGIBLE COSTS OF A TRASPORTATION FEDERALAID
PROJECT ON SAW MILL RIVER ROAD, FROM TUCKAHOE ROAD
TO ASHBURTON AVENUE, AND APPROPRIATING FUNDS.
WHEREAS, a project for the reconstruction of Saw Mill River Road
from Tuckahoe Road to Ashburton Avenue in the City of Yonkers, in
Westchester County, identified as PIN 8103.31, is eligible for funding
under a Title 23, US Code, as amended, calls for the costs for such
project to be borne at the ratio of 80 % Federal Funds and 20% nonfederal
funds; and
WHEREAS, by Resolution No. 3-2001 adopted on January 9, 2001,
the Yonkers City Council approved of, and agreed to making a
commitment of 100% of the non-federal share of costs for the preliminary
engineering and right-of-way incidental work, or portions thereof, and
WHEREAS, by Resolution No. 3-2001, the Yonkers City Council
authorized the appropriation of $240,000 from the 1999/2000 Budget for
the City of Yonkers under the Grants Section, subsection 1508 entitled
“Reconstruction of Saw Mill River Road” and made available to cover the
cost of participation in the Preliminary Engineering and Right-of-Way
Incidental phase of the project; and
WHEREAS, it has been found necessary to undertake additional
preliminary engineering work for the above-subject Project not
contemplated in the original Agreement authorized by the previous
Resolution adopted by the Yonkers City Council; and
WHEREAS, it has been found necessary to increase the costs for
the additional preliminary engineering work for the above-subject Project;
and
WHEREAS, the City of Yonkers desires to advance the project by
making a commitment of 100% of the non-federal share of the costs of the
additional preliminary engineering work for the project or portions thereof.

share of the cost of the additional preliminary engineering work
and the construction, construction inspection and construction supervision
work for the Project or portions thereof; and it is further
RESOLVED, that the sum of $5,406,000.00 (which equals
$5,646,000.00 minus the previous $240,000.00) is hereby appropriated as
follows $1,119,382.52 from 060 008 0461 0200; and $967, 038.48 from
060 008 0503 0200; $3,272,000.00 from 049 G12 1508 0201 and
$47,579. from 049 G12 1508 0413 and made available to cover the cost
of participation in the above design and construction phases of the
Project; is hereby appropriated from the aforementioned Grant and Budget
lines for the City of Yonkers; year 2006-2007 for the accounts 060 008
0461 0200 and 060 008 0503 0200, and the year 1999-2000 for the
accounts 049 G12 1508 0201 and 049 G12 1508 0413; and it is hereby
further
RESOLVED, that in the event of the full federal and non-federal
share costs of the project exceeds the amount appropriated above, the
Yonkers City Council shall convene as soon as possible to appropriate
said excess amount immediately upon the notification by the Mayor
thereof; and it is further
RESOLVED, that the Mayor be and is hereby authorized to execute
all necessary Agreements, certifications or reimbursement requests for
Federal Aid and/or Marchiselli on behalf of the City of Yonkers with the
New York State Department of Transportation in connection with the
advancement or approval of the Project providing for the administration of
the Project and the City of Yonkers funding of the non-federal share of the
project costs and permanent funding of the local share of federal-aid and
state-aid eligible project costs and all Project costs within appropriations
therefore that are not so eligible, and it is hereby further
RESOLVED, that a certified copy of this resolution be filed with the
New York State Commissioner of Transportation by attaching it to any
necessary Agreement in connection with the projects, and

AN ORDINANCE CONFIRMING THE TAX ROLL FOR WESTCHESTER
COUNTY TAXES, INCLUDING SEWER DISTRICT TAXES AND REFUSE
DISPOSAL DISTRICT TAXES, FOR THE CALENDAR YEAR 2009, AND
LEVYING AND ASSESSING THE TAXES CONTAINED THEREIN.
The City of Yonkers, in the City Council convened, hereby ordains
and enacts:
Section 1. The apportionment and extension of the assessment
roll of Westchester County Taxes for the calendar year 2009, including
sewer district taxes and refuse disposal district taxes, having been
completed by the City Assessor at the direction of the City Council, said
apportionment and extension constitutes the tax rolls for Westchester
County Taxes and said taxes are hereby levied and assessed on the real
property appearing thereon as therein set forth.
Section 2. The Mayor is authorized to sign and attach to such tax
rolls a warrant under the corporate seal of the City allowing the City
Comptroller to collect, in the manner provided by law, the taxes set forth
therein, and the City Assessor is hereby directed to deliver the said tax
rolls to the Comptroller.
Section 3. This ordinance shall take effect immediately.

AN ORDINANCE AUTHORIZING AND PERMITTING THE PROPERTY
OF 125 PARKVIEW AVE. BLOCK 5664 LOT (S) 7 TO MAKE A LONG
HOUSE CONNECTION TO THE CITY'S SANITARY SYSTEM IN
PARKVIEW AVE. (NO EXPENSE TO THE CITY OF YONKERS).
The City of Yonkers, in City Council convened, hereby ordains and
enacts:
Section 1. Permission is hereby granted to the property owner of
125 Parkview Ave., Block 5664 Lot(s) 7 to make a long house sanitary
sewer connection from said lot to a city sanitary sewer in Parkview Ave.
at his own cost and expense and in accordance with the plan submitted by
Eliot Senor, Professional Engineer #81627 dated March 28, 2008, filed in
the Plumbing Division, subject to the conditions of a Plumbing Permit to be
secured from the Plumbing Division and a street opening permit to be
secured from the City Engineer.
Section 2. This permission is granted under the following terms
and conditions, to wit:
The granting of this permission shall, in no way, free or release the
said owner, or his successors, from the payment of any assessments or
benefits accruing to said lot by reason of the construction of any sanitary
sewer already built, or that hereafter shall be built, to serve the area within
which the lot herein referred to is located.
The cost of construction, maintenance and repairs of said long
house connection shall be the responsibility of the owner of the building
served by the long house connection.

($1,420.67) of the claim entitled, " In the Matter of Michael Michelin,
(residing at 241 Croydon Road) claimant against the City of Yonkers,
respondent", for property damage arising out of an alleged accident
alleging that his vehicle was damaged by a Yonkers Fire Engine while it
was parked and unattended in front of 241 Croydon Road, be and the
same hereby is approved and the Comptroller of the City of Yonkers is
directed to draw his warrant in the amount of one thousand four hundred

RESOLVED, by the City Council of the City of Yonkers, in meeting
assembled:
That the settlement by the Corporation Counsel in the amount of
one thousand five hundred dollars ($1,500.00) of the action entitled, "In
the Matter of the Claim of Frank Sanchez, (residing at 100 College
Avenue, Apt 4K, Sleepy Hollow, New York 10591) plaintiffs against The
City of Yonkers, Defendant", for property damage arising out of an
accident alleging that damage was sustained to his vehicle after a City
vehicle struck his vehicle while it was stopped at a stop sign on Waverly
Street, be and the same hereby is approved and the Comptroller of the
City of Yonkers is directed to draw his warrant in the amount of one
thousand five hundred dollars and no cents ($1,500.00) in favor of said
plaintiff Frank Sanchez.

number 07 Civ. 9513 (NRB); for violations of civil rights allegedly
sustained by plaintiff in the course of his being detained by City of Yonkers
police officers on April 26, 2007; be and the same hereby is approved and

RESOLUTION
7. BY COUNCIL PRESIDENT LESNICK, MAJORITY LEADER ANNABI,
MINORITY LEADER McLAUGHLIN, COUNCILMEMBERS McDOW,
GRONOWSKI, MURTAGH AND BARBATO:
WHEREAS, private individuals and interested parties are seeking
to make monetary donations to assist in the development and
maintenance of a new City of Yonkers Animal Shelter facility, and it is
proposed that the City of Yonkers coordinate such donations to be used
for the public purpose of developing the City of Yonkers Animal Shelter
facility; and
WHEREAS, the current Yonkers Animal Shelter was designed for
animal control, and as presently constituted is undersized and improperly
equipped to allow for the adoption of healthy animals; and
WHEREAS, the a new Yonkers Animal Shelter facility would allow
for the adoption of healthy animals and decrease the current burden on
housing stray animals; and
WHEREAS, the Mayor and the City Council wish to assist in the
development of a new City of Yonkers Animal Shelter facility; and
WHEREAS, donations made to the City of Yonkers to assist in the
development of a City of Yonkers Animal Shelter facility further the public
purpose of the humane treatment of stray animals and enhance the quality
of life for residents of the City of Yonkers; therefore be it
RESOLVED, that the City Council of the City of Yonkers hereby
supports the creation of a special fund for donations to be used for the
development efforts of a new City of Yonkers Animal Shelter facility; and
be it further
RESOLVED, that the City Council requests that the Commissioner
of Finance and Management Services (the “Commissioner of Finance”) is
hereby directed to set up and manage the records of a separate account
entitled “City of Yonkers Animal Shelter Fund” to be funded solely by
private donations and to be used for expenses related to the development
of a new City of Yonkers Animal Shelter facility; and be it further
RESOLVED, that the Mayor is authorized to take whatever steps
necessary to effectuate this resolution; and be it further

RESOLVED, that the Commissioner of Finance and Management
Services and the Commissioner of Parks and Recreation are authorized to
make a full report to the City Council on the development and
maintenance of the new facility and an accounting of the funds donated
and held in said separate account within one year from the creation of said
separate account and every year thereafter, until the account is no longer
used and closed, and copies of such reports shall be made available to
the public; and be it further

8. BY COUNCIL PRESIDENT LESNICK, MAJORITY LEADER ANNABI,

GRONOWSKI, MURTAGH AND BARBATO:
A RESOLUTION AUTHORIZING THE IMPLEMENTATION AND
FUNDING OF THE FEDERAL AID AND STATE “MARCHISELLI”
PROGRAM-AID ELIGIBLE COSTS OF A TRASPORTATION FEDERALAID
PROJECT ON SAW MILL RIVER ROAD, FROM TUCKAHOE ROAD
TO ASHBURTON AVENUE, AND APPROPRIATING FUNDS.
WHEREAS, a project for the reconstruction of Saw Mill River Road
from Tuckahoe Road to Ashburton Avenue in the City of Yonkers, in
Westchester County, identified as PIN 8103.31, is eligible for funding
under a Title 23, US Code, as amended, calls for the costs for such
project to be borne at the ratio of 80 % Federal Funds and 20% nonfederal
funds; and
WHEREAS, by Resolution No. 3-2001 adopted on January 9, 2001,
the Yonkers City Council approved of, and agreed to making a
commitment of 100% of the non-federal share of costs for the preliminary
engineering and right-of-way incidental work, or portions thereof, and
WHEREAS, by Resolution No. 3-2001, the Yonkers City Council
authorized the appropriation of $240,000 from the 1999/2000 Budget for
the City of Yonkers under the Grants Section, subsection 1508 entitled
“Reconstruction of Saw Mill River Road” and made available to cover the
cost of participation in the Preliminary Engineering and Right-of-Way
Incidental phase of the project; and
WHEREAS, it has been found necessary to undertake additional
preliminary engineering work for the above-subject Project not
contemplated in the original Agreement authorized by the previous
Resolution adopted by the Yonkers City Council; and
WHEREAS, it has been found necessary to increase the costs for
the additional preliminary engineering work for the above-subject Project;
and
WHEREAS, the City of Yonkers desires to advance the project by
making a commitment of 100% of the non-federal share of the costs of the
additional preliminary engineering work for the project or portions thereof.

NOW, THEREFORE, the Yonkers City Council duly convened,
approves of the project; and it is hereby further
RESOLVED that the Yonkers City Council hereby authorizes the
City of Yonkers to pay in the first instance 100% of the federal and nonfederal
share of the cost of the additional preliminary engineering work
and the construction, construction inspection and construction supervision
work for the Project or portions thereof; and it is further
RESOLVED, that the sum of $5,406,000.00 (which equals
$5,646,000.00 minus the previous $240,000.00) is hereby appropriated as
follows $1,119,382.52 from 060 008 0461 0200; and $967, 038.48 from
060 008 0503 0200; $3,272,000.00 from 049 G12 1508 0201 and
$47,579. from 049 G12 1508 0413 and made available to cover the cost
of participation in the above design and construction phases of the
Project; is hereby appropriated from the aforementioned Grant and Budget
lines for the City of Yonkers; year 2006-2007 for the accounts 060 008
0461 0200 and 060 008 0503 0200, and the year 1999-2000 for the
accounts 049 G12 1508 0201 and 049 G12 1508 0413; and it is hereby
further
RESOLVED, that in the event of the full federal and non-federal
share costs of the project exceeds the amount appropriated above, the
Yonkers City Council shall convene as soon as possible to appropriate
said excess amount immediately upon the notification by the Mayor
thereof; and it is further
RESOLVED, that the Mayor be and is hereby authorized to execute
all necessary Agreements, certifications or reimbursement requests for
Federal Aid and/or Marchiselli on behalf of the City of Yonkers with the
New York State Department of Transportation in connection with the
advancement or approval of the Project providing for the administration of
the Project and the City of Yonkers funding of the non-federal share of the
project costs and permanent funding of the local share of federal-aid and
state-aid eligible project costs and all Project costs within appropriations
therefore that are not so eligible, and it is hereby further
RESOLVED, that a certified copy of this resolution be filed with the
New York State Commissioner of Transportation by attaching it to any
necessary Agreement in connection with the projects, and

WHEREAS, Yoho Arts Studios, located at the Nepperhan Business
Center, 540 – 578 Nepperhan Avenue in Yonkers, has an up coming
event called YOHO ARTISTS OPEN STUDIO April 18th and 19th 2009.
Yoho Arts Studios has asked that they be permitted from the City Council
to place banners in areas promoting this event, and
WHEREAS, Yoho Arts Studios has asked that they be permitted to
place three (3) banners at the following locations on or before April 1,
2009 and to be removed as soon after April 19, 2009 as is possible:

WHEREAS, Sacred Heart High School has an up coming
production called “Hello, Dolly!” April 3rd, 4th and 5th 2009. Sacred Heart
High School has requested permission from the City Council to place a
banner in an area promoting this event, and
WHEREAS, Sacred Heart High School has asked that they be
permitted to place one (1) banner on the corner of North Broadway and
Gateway Road on or before March 4, 2009 and to be removed as soon
after April 5, 2009 as is possible.
NOW, THEREFORE BE IT RESOLVED, that the City Council of the
City of Yonkers hereby grants permission to Sacred Heart High School to
place one banner in the aforementioned location, subject to any terms and

WHEREAS, in 1988, the City of Yonkers hired the independent
consulting firm of Murphy, Mayo and Associates, to conduct a
comprehensive study of the Yonkers Police Department to identify its
strengths and weaknesses;
WHEREAS, in 1989, this study resulted in a 49-page report,
prepared by former New York City Police Commissioner Patrick V. Murphy
and his associate, Louis A. Mayo, former president of the National Institute
of Justice;
WHEREAS, this management study included an analysis of the
Police Department’s goals, specialized police units, foot patrol
assignments and overtime policies;
WHEREAS, for the past several years, the Comptroller of the State
of New York has cited the City of Yonkers for excessive overtime in both
the police and fire departments, calling upon the city to adjust its
deployment of uniformed personnel or identify other measures to reduce
overtime and overtime expenditures;
WHEREAS, the City of Yonkers has commenced several significant
development projects and many more are in the review process, which will
undoubtedly impact services to our residents;
NOW, THEREFORE, BE IT RESOLVED, that the City Council of
the City of Yonkers requests that the City Administration commission
comprehensive management studies of the Police and Fire Departments
by experienced and politically impartial management consultants, to
analyze and right-size the police and fire organizations with a view toward
reducing overtime, to ensure that the departments operate as costeffectively
as possible, now and in the years to come..

2009, and has requested permission from the City Council to place two
banners in the area promoting this event, and
WHEREAS, Our Lady of Fatima School has asked that they be
permitted to place two (2) banners at the location of Central Park Ave. &
Sadore Lane, on the pedestrian over-pass (one north-bound and the other
south-bound) or where ever convenient in that same area on Central Park
Ave., on or around April 9, 2009, and to be removed as soon after May 8,
2009 as is possible.
NOW, THEREFORE BE IT RESOLVED, that the City Council of the
City of Yonkers hereby grants permission to Our Lady of Fatima School to
place two banners in the aforementioned location, subject to any terms
and conditions deemed appropriate by the Administration to protect the

RESOLVED, by the City Council of the City of Yonkers, in meeting
assembled:
That the settlement by the Corporation Counsel in the amount of
SEVEN HUNDRED FORTY FIVE and 00/100 DOLLARS ($745.00) of the
action entitled ERIC AIESE, Plaintiff against City of Yonkers, as
Defendant, for property damage resulting from an alleged accident when
his parked vehicle was struck by a City of Yonkers Police vehicle in front
of 3 Phillipse Place, Yonkers hereby is approved and the Comptroller of
the City of Yonkers is directed to draw his warrant in the amount of
SEVEN HUNDRED FORTY FIVE AND 00/100 DOLLARS ($745.00) in
favor of said plaintiff.

That the settlement by the Corporation Counsel in the amount of
TWENTY THOUSAND DOLLARS ($20,000.00) of the action entitled,
"Juliette Marie McNulty, (residing at 118 Devoe Avenue, Yonkers, New
York 10705) plaintiffs against The City of Yonkers and Joseph Spano,
Defendants", for personal injuries and medical expenses arising out of an
alleged accident alleging that were sustained by said party of the second
part as a result of an automobile accident at the intersection of Wendover
Road and Bajart Place, in the City of Yonkers., on January 20, 2005, be
and the same hereby is approved and the Comptroller of the City of
Yonkers is directed to draw his warrant in the amount of TWENTY

4. BY COUNCILMEMBER GRONOWSKI, COUNCIL PRESIDENT LESNICK,
MAJORITY LEADER ANNABI, MINORITY LEADER McLAUGHLIN,
COUNCILMEMBERS McDOW, MURTAGH AND BARBATO:
WHEREAS, in 1988, the City of Yonkers hired the independent
consulting firm of Murphy, Mayo and Associates, to conduct a
comprehensive study of the Yonkers Police Department to identify its
strengths and weaknesses;
WHEREAS, in 1989, this study resulted in a 49-page report,
prepared by former New York City Police Commissioner Patrick V. Murphy
and his associate, Louis A. Mayo, former president of the National Institute
of Justice;
WHEREAS, this management study included an analysis of the
Police Department’s goals, specialized police units, foot patrol
assignments and overtime policies;
WHEREAS, for the past several years, the Comptroller of the State
of New York has cited the City of Yonkers for excessive overtime in both
the police and fire departments, calling upon the city to adjust its
deployment of uniformed personnel or identify other measures to reduce
overtime and overtime expenditures;
WHEREAS, the City of Yonkers has commenced several significant
development projects and many more are in the review process, which will
undoubtedly impact services to our residents;
NOW, THEREFORE, BE IT RESOLVED, that the City Council of
the City of Yonkers requests that the City Administration commission
comprehensive management studies of the Police and Fire Departments
by experienced and politically impartial management consultants, to
analyze and right-size the police and fire organizations with a view toward
reducing overtime, to ensure that the departments operate as costeffectively
as possible, now and in the years to come..

WHEREAS, Our Lady of Fatima School, located at 963 Scarsdale
Road. in Yonkers will hold its annual Penny Social on Friday, May 8,
2009, and has requested permission from the City Council to place two
banners in the area promoting this event, and
WHEREAS, Our Lady of Fatima School has asked that they be
permitted to place two (2) banners at the location of Central Park Ave. &
Sadore Lane, on the pedestrian over-pass (one north-bound and the other
south-bound) or where ever convenient in that same area on Central Park
Ave., on or around April 9, 2009, and to be removed as soon after May 8,
2009 as is possible.
NOW, THEREFORE BE IT RESOLVED, that the City Council of the
City of Yonkers hereby grants permission to Our Lady of Fatima School to
place two banners in the aforementioned location, subject to any terms
and conditions deemed appropriate by the Administration to protect the
best interests of the City of Yonkers.
