There will be a Community Services Committee Meeting Wednesday, April 30, 2008 at 6pm in Ceremonial Courtroom, 4th Floor City Hall regarding recent alleged gang activity at the Glenwood Station Power Plant. By copy of this email, I am asking that the Administration send representatives from the Buildings and Police Departments to this meeting to discuss this issue. Ken Capolino of K. LOCAL LAW
1. BY COUNCIL PRESIDENT LESNICK, MAJORITY LEADER ANNABI,
MINORITY LEADER McLAUGHLIN, COUNCILMEMBERS, McDOW,
GRONOWSKI, MURTAGH AND BARBATO:
A Local Law to adopt Westchester County Greenway Compact Plan.
Be it enacted by the City Council of the City of Yonkers as follows:
Section 1. Adoption of Westchester County Greenway Compact Plan
1. Pursuant to the provisions of Section 44-0119 of the
Environmental Conservation Law of the State of New York, the City
of Yonkers hereby adopts the statement of policies, principles and
guides detailed in The Greenprint for a Sustainable Future…the
Westchester Way, the Westchester County Greenway Compact
Plan, by which the City of Yonkers becomes a participating
community in the Greenway Compact.
2. Proposals to amend the Compact Plan may from time to time be
made by the Hudson River Valley Greenway Communities Council
(hereinafter referred to as "Greenway Council") in response to
requests from participating communities. Within 90 days of receipt
of any such proposal from the Greenway Council, the City Council
of the City of Yonkers shall determine by resolution whether to
accept or to reject such proposed amendment. Any proposed
amendment so accepted shall be considered an amendment of the
Compact Plan as adopted by the City of Yonkers. Any proposed
amendment rejected by the City of Yonkers will not be considered
to be an amendment of the Greenway Plan for the City of Yonkers
and notice of such rejection shall promptly be provided to the
Greenway Council.
3. It is stated policy of the City of Yonkers that, to the extent the City
amends its current, or enacts new, land use laws and regulations,
such new or amended laws and regulations, where appropriate,
should be designed to be consistent with the Compact Plan.

Section 2. Amendment of Zoning Code
To implement the Compact Plan in the City of Yonkers the Zoning chapter
of the Code of the City of Yonkers is hereby amended by the addition of
the following provision:
§ Westchester County Greenway Compact Plan. By Local Law No. of
the Year 2008 the City of Yonkers has adopted the Compact Plan, as
amended from time to time, as a statement of policies, principles, and
guides to supplement
Other established land use policies in the City. In its discretionary actions
under this zoning code, the reviewing agency should take into
consideration said statement of policies, principles and guides, as
appropriate.
Section 3. Amendment of Subdivision Code
To implement the Compact Plan in the City of Yonkers, the Subdivision of
Land chapter of the Code of the City of Yonkers is hereby amended by the
addition of the following provision:
§ Westchester County Greenway Compact Plan. By Local Law No. of
the Year 2008 the City of Yonkers has adopted the Compact Plan, as
amended from time to time, as a statement of policies, principles, and
guides to supplement other established land use policies in the City. In its
discretionary actions under this subdivision code, the reviewing agency
should take into consideration said statement of policies, principles and
guides, as appropriate.
Section 4. Home Rule of Authority
Nothing in this Local Law adopting the Compact Plan, or in becoming a
participating community in the Compact Plan is intended, or shall be
construed (a) to limit the home rule authority of the City under State Law
to make local land use and zoning decisions, (b) to authorize any other
entity to supersede the City's land use laws and regulations or to impose
any requirements on the City, or (c) to prevent the City in its sole
discretion from adopting a local law at a later date for the purpose of
withdrawing from the Greenway Compact or Westchester County
Greenway Compact Plan.

Section 5. Separability
If any part or provision of this Local Law or the application thereof to any
person or circumstance be adjudged invalid by any court of competent
jurisdiction, such judgment shall be confined in its operation to the part of
provision or application directly involved in the controversy in which
judgment shall have been rendered and shall not affect or impair the
validity of the remainder of this Local Law or the application thereof to
other persons or circumstances, and the City of Yonkers hereby declares
that it would have passed this Local Law or the remainder thereof had
such invalid application or invalid provision been apparent.
Section 6. Effective Date
This Local Law shall take effect immediately upon filing in the office of the
Secretary of State in accordance with Section 27 of the Municipal Home
Rule Law.

A SPECIAL ORDINANCE AUTHORIZING AND DIRECTING THE
ACQUISITION OF THE FOLLOWING PROPERTY REQUIRED IN
CONNECTION WITH THE DEVELOPMENT OF A PUBLIC ATHLETIC
FIELD AND PLAYGROUND:
SECTION 1, BLOCK 154, LOTS 55.67
(58 PURSER PLACE).
The City of Yonkers, in City Council convened, hereby ordains and
enacts:
Section 1. It is hereby ordered and directed that certain parcel of
property, referenced above and as identified on the Official Tax Map of the
City of Yonkers, be acquired for public or municipal purposes, more
specifically, the establishment of a public athletic field and playground.
Section 2. For the purposes of acquiring said property, the Mayor
or the Commissioner of Public Works is hereby authorized to acquire for
the City of Yonkers the aforesaid lands by gift or purchase, at a price to be
approved by the City Council, or by the procedure set forth in Article XX of
the Charter of the City of Yonkers, as amended, or by proceedings as set
forth in the Eminent Domain Procedure Law (“EDPL”).
Section 3. The property shall not be transferred to the City by
Eminent Domain, or through any other means, without additional City
Council approval.
Section 4. The whole cost and expense of acquiring the aforesaid
property shall be borne by the City-at-large.

RESOLVED, by the City Council of The City of Yonkers, in meeting
assembled:
That the settlement by the Corporation Counsel in the amount of
EIGHT HUNDRED TWO AND 67/100 DOLLARS ($802.67), of the action
entitled “LIBERTY MUTUAL INSURANCE COMPANY a/s/o RICHARD
LAMADORE, Plaintiff, (residing at 227 Helena Avenue, Yonkers, New
York 10710), against the CITY OF YONKERS, Defendant”, for property
damage arising out of an incident on March 17, 2007 when a truck owned
by the City of Yonkers and operated by Vincent Galli, a City employee
assigned to the Department of Public Works, struck claimant’s vehicle
which was parked and unoccupied on Helena Avenue, in front of 227
Helena Avenue, in the City of Yonkers, be and the same hereby is
approved and the Comptroller of the City of Yonkers is directed to draw
his warrant in the amount of EIGHT HUNDRED TWO AND 67/100
DOLLARS ($802.67) in favor of said plaintiff.

RESOLUTION
4. BY COUNCIL PRESIDENT LESNICK, MAJORITY LEADER ANNABI,

WHEREAS, an anonymous donor has agreed to give the sum of
$1,252.38 to Project Friendship, the City’s Program for the
Developmentally Disabled run by the Department of Parks, Recreation
and Conservation;
WHEREAS, because of this generous donation, the Department of
Parks, Recreation and Conservation will be able to purchase new hockey
equipment for the Special Olympics Floor Hockey Team;
RESOLVED, the City Council of the City of Yonkers upon receipt of
this donation hereby acknowledges this generous gift from the anonymous
donor and be it further;
RESOLVED, that this resolution will take effect immediately.

LANDMARKS PRESERVATION BOARD AND DESIGNATING THE
PHILIPSE MANOR HISTORIC DISTRICT AT 6-8 WELLS AVENUE; 52-54
WARBURTON AVENUE; 50 WARBURTON AVENUE; 48 WARBURTON
AVENUE; 46 WARBURTON AVENUE; 44 WARBURTON AVENUE; 42
WARBURTON AVENUE; 40 WARBURTON AVENUE; 38 WARBURTON
AVENUE; 36 WARBURTON AVENUE; 11 MANOR HOUSE SQUARE; 9
MANOR HOUSE SQUARE; AND 5 MANOR HOUSE SQUARE AS A
LANDMARK PURSUANT TO SECTION 45–5 F OF THE CODE OF THE
CITY OF YONKERS.
WHEREAS, the Yonkers Landmarks Preservation Board has
considered the application to locally landmark the thirteen properties
known as the Philipse Manor Historic District at 6-8 Wells Avenue; 52-54
Warburton Avenue; 50 Warburton Avenue; 48 Warburton Avenue; 46
Warburton Avenue; 44 Warburton Avenue; 44 Warburton Avenue; 42
Warburton Avenue; 40 Warburton Avenue; 38 Warburton Avenue; 36
Warburton Avenue; 11 Manor House Square; 9 Manor Square; and 5
Manor House Square, pursuant to the Code of the City of Yonkers; and
WHEREAS, the aforementioned properties designed by various
Yonkers architects, represent a variety of styles that form a harmonious
unit in scale with their dramatic surroundings of hills, cliffs and related 19th
Century architecture, not to mention a unit that harmonizes with the
characteristic Yonkers pattern of intersecting, curving streets and with a
public square of moderate width and essentially human scale that is
unique to Yonkers; and
WHEREAS, these properties stand in close proximity to Philipse
Manor Hall, the most important Colonial House in Southern Westchester
County, an 18th Century mansion whose own history is intimately bound to
Yonkers, it was owned by the Philipse family, who farmed the land, and
George Washington paid court to the daughter of the house, it is centered
in James Fenimore Cooper’s Novel “The Spy”, and during the last three
decades of the 19th Century, Philipse Manor Hall served as both Yonkers
Town Hall and Yonkers City Hall; and

WHEREAS, one of the buildings, 50 Warburton Avenue, was also
designed by the firm of Edwin A. Quick & Sons, who were also the
designers of Yonkers City Hall; and
WHEREAS, the Yonkers Landmarks Preservation Board, finding
that the Philipse Manor Historic District met the technical criteria for
qualifying as a landmark, by a unanimous vote, moved to locally landmark
the Philipse Manor Historic District and referred the matter to the City
Council; and
WHEREAS, the City Council of the City of Yonkers finds that the
Philipse Manor Historic District still retains a level of historic and
architectural character that warrants local landmarking.
NOW THEREFORE BE IT RESOLVED, by the City Council of the
City of Yonkers that the City Council of the City of Yonkers hereby accepts
the recommendation of the Yonkers Landmarks Preservation Board and
approves the local landmarking of the Philipse Manor Historic District
located at 6-8 Wells Avenue; 52-54- Warburton Avenue; 50 Warburton
Avenue; 48 Warburton Avenue;46 Warburton Avenue; 44 Warburton
Avenue; 42 Warburton Avenue; 40 Warburton Avenue; 38 Warburton

WHEREAS, the City Council requests that the County of
Westchester (the “County”) investigate the feasibility of purchasing
63 North Broadway, Yonkers, N.Y. 10701, Block 2017, Lot 1 for
the purpose of building affordable housing; and
WHEREAS, the City is of the opinion that the purchase of
this property by the County will assist the City in its goal of
providing proper, efficient and appropriate affordable housing in our
City by allowing the revitalization of the City; and
NOW THEREFORE, BE IT RESOLVED by the City Council
of the City of Yonkers that the City of Yonkers hereby requests that
the County of Westchester investigate the feasibility of purchasing
the property located at 63 North Broadway, Yonkers N.Y. 10701,
Block 2017, lot 1, for use the purpose of building affordable
housing; and be it further
RESOLVED, that this resolution shall take effect
immediately.

RESOLUTION OF THE CITY COUNCIL: (1) APPROVING THE SURVEY
AREA STUDY SUBMITTED BY STRUEVER FIDELCO CAPPELLI LLC;
(2) APPROVING THE BOUNDARIES OF THE PROJECT AREA; AND (3)
AUTHORIZING STRUEVER FIDELCO CAPPELLI LLP TO PREPARE A
PRELIMINARY PLAN FOR THE REDEVELOPMENT PROJECT.
WHEREAS, on October 24, 2006, Struever Fidelco Cappelli LLC
(“SFC”) duly filed an Application/Petition with the City Clerk for certain
approvals from the City Council for the development of the projects known
and described in the Application/Petition as “Palisades Point,” “River Park
Center” and “Cacace Center” (collectively, the “SFC Project”); and
WHEREAS, the Application/Petition requests that the City Council
establish a “redevelopment project” under New York General Municipal
Law Article 18-C within the area of the City described in Exhibit 8 to the
Application/Petition (such area, the “Survey Area”); and
WHEREAS, the Application/Petition requests that the City issue tax
increment bonds and/or tax increment bond anticipation notes for the
purpose of carrying out and/or administering a redevelopment plan for the
proposed redevelopment project within the Survey Area, the proceeds of
which would be used for the objects and purposes set forth in New York
General Municipal Law Section 970-o(h)(i)-(iv); and
WHEREAS, SFC proposes to develop the SFC Project within the
Survey Area; and
WHEREAS, the City may issue tax increment bonds and/or tax
increment bond anticipation notes only in furtherance of a redevelopment
project duly established under New York General Municipal Law Article
18-C; and
WHEREAS, on February 13, 2007, the City Council adopted
Resolution No. R.17-2007, pursuant to which the City Council: (1) found
that it is appropriate to undertake a survey area study to determine

whether a redevelopment project in the Survey Area is feasible; (2)
authorized and directed SFC to undertake, at SFC’s sole cost and
expense, the survey area study on behalf of the City Council; and
WHEREAS, SFC has prepared a combination survey area study
and draft preliminary plan entitled “Tax Increment Financing Feasibility
Study and Preliminary Redevelopment Plan,” dated July, 2007 and
revised January, 2008 (the “Survey Area Study”); and
WHEREAS, the Survey Area Study is attached to the Draft
Environmental Impact Statement for the SFC Project (the “DEIS”) as
Appendix 1.F; and
WHEREAS, on March 18, 2008, the DEIS was accepted by the City
Council as adequate and complete for the purpose of commencing public
review; and
WHEREAS, the City Council has reviewed the Survey Area Study
and the comment memoranda prepared by G. Lamont Blackstone, the
Council’s consultant, dated December 7, 2007, December 17, 2007 and
April 14, 2008; and
WHEREAS, in his April 14, 2008 memorandum and in his oral
presentation to the Real Estate Committee of the City Council on April 15,
2008, G. Lamont Blackstone recommended that the City Council accept
the Survey Area Study, exclusive of the draft preliminary plan., “as
complete subject to [SFC] submitting satisfactory responses or information
on the pending or incomplete items” identified in the memorandum.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the
City of Yonkers that the City Council hereby approves the Survey Area
Study solely for the purposes set forth in New York General Municipal law
Section 970-d, and not as a preliminary plan under New York General
Municipal Law Section 970-e; and be it further
RESOLVED, that the Survey Area Study is approved subject to
SFC submitting, as part of the preliminary plan, satisfactory responses or
information on the pending or incomplete items identified in the April 14,
2008 memorandum prepared by G. Lamont Blackstone; and be it further

RESOLVED, that the “project area” (as that term is defined in New
York General Municipal Law Section 970-c(g)) is bounded as shown on
the map attached to this Resolution, and consists of the properties
identified in the list attached to this Resolution; and be it further
RESOLVED, that pursuant to New York General Municipal Law
Section 970-e, the City Council authorizes and directs SFC to prepare a
preliminary plan for the redevelopment project on behalf of the City
Council; and be it further
RESOLVED, that the preliminary plan shall include that matters set
forth in New York General Municipal Law Section 970-e, and shall address
the comments in the April 14, 2008 memorandum prepared by G. Lamont
Blackstone; and be it further
RESOLVED, that SFC shall undertake the preparation of the
preliminary plan at SFC’s sole cost and expense; and be it further
RESOLVED, that the City Council does not by this resolution
commit to establish a redevelopment project within the project area, but
only to authorize the preparation of a preliminary plan for a redevelopment
project, if approved, pursuant to the Municipal Redevelopment Law; and
be it further
RESOLVED, that this resolution shall take effect immediately.

RESOLUTION
8. BY COUNCIL PRESIDENT LESNICK, MAJORITY LEADER ANNABI,
COUNCILMEMBER GRONOWSKI, MINORITY LEADER McLAUGHLIN,
COUNCILMEMBERS, McDOW, MURTAGH AND BARBATO:
WHEREAS, in the City of Yonkers we have many
community based organizations interested in community renewal
and economic development; and
WHEREAS, the South Broadway Business Improvement
District (BID) has submitted an application to the New York State
Division of Housing and Community Renewal for a New Main
Street grant in the amount of $165,000; and
WHEREAS, the South Broadway corridor serves as a
gateway into Yonkers from New York City, while simultaneously
hosting merchants and residential community who continue to
strive and maintain and improve the quality of life for all in the
South Broadway area; and
WHEREAS, the façade and building renovations of 242-
248, 373-379 South Broadway and 1 Post Street are important
efforts in the revitalization and development of the South
Broadway corridor, and is included in the scope of this grant
application; and
WHEREAS, the South Broadway corridor is defined as the
section of South Broadway between the city line and Vark Street,
and the grant would be used in the targeted area, defined as the
area between 1 Post Street and 242 South Broadway; and
THEREFORE, BE IT RESOLVED, that the Yonkers City
Council supports the South Broadway BID’s application to the
Main Street Program.

WHEREAS, St. Michael’s Ukrainian Catholic Church and the
Yonkers branch of the Ukrainian American Youth Association will
celebrate their Twenty-Third Annual Yonkers Ukrainian Heritage Festival
on June 13, 14th and 15th of 2008; and
WHEREAS, this three-day event will take place on the grounds of
St. Michael’s Ukrainian Catholic Church, located at the corner of 510
North Broadway & 21 Shonnard Place; and
WHEREAS, the Ukrainian Heritage Committee has requested
permission from the City Council to place promotional banners in the
surrounding area; and
WHEREAS, the Heritage Committee has asked that they be
permitted to place four (4) banners at the following locations on or before
May 29th, to be removed as soon after June 15th as is possible:
1. North Broadway, in front of St. John’s Hospital – toward
Executive Blvd.
2. Saw Mill River Road between Lockwood Avenue and Palmer
Road
3. Yonkers Avenue in front of Gold’s Gym and Great Bear Mufflers
4. On the Tuckahoe Road Bridge going over Central Park Avenue to be
read by those traveling south on Central Park Avenue and Tuckahoe
Road
NOW, THEREFORE BE IT RESOLVED that the City Council of the
City of Yonkers hereby grants permission to the Heritage Committee to
place four banners in the aforementioned locations, subject to any terms
and conditions deemed appropriate by the Administration to protect the
best interests of the City of Yonkers.

dividends, total gain from the sale or exchange of a capital asset which
may be offset by a loss from the sale or exchange of a capital asset in the
same income tax year, net rental income, salary or earnings and net
income from self-employment, but shall not include a return of capital, gifts
or inheritances. In computing net rental income and net income from selfemployment,
no depreciation deduction shall be allowed for the
exhaustion, wear and tear of real or personal property held for the

Section 1. It is hereby ordered and directed that certain parcel of
property, referenced above and as identified on the Official Tax Map of the
City of Yonkers, be acquired for public or municipal purposes, more
specifically, the establishment of a public athletic field and playground.
Section 2. For the purposes of acquiring said property, the Mayor
or the Commissioner of Public Works is hereby authorized to acquire for
the City of Yonkers the aforesaid lands by gift or purchase, at a price to be
approved by the City Council, or by the procedure set forth in Article XX of

DESIGNATION OF HUDSON VIEW ASSOCIATES, LLC AS ELIGIBLE
SPONSOR AND APPROVING THE TERMS AND CONDITIONS OF
PROPOSED LAND DISPOSITION AGREEMENT PROVIDING FOR THE
DISPOSITION OF A PORTION OF VACANT LAND DESIGNATED AS
SECTION 2, BLOCK 2015, LOT 95 ON THE TAX MAP OF CITY OF
YONKERS
WHEREAS, in furtherance of the objectives of Articles XV and XVA
of the General Municipal Law of the State of New York, as amended,
the City of Yonkers (the “City”) and the Yonkers Community Development
Agency (the “Agency”) have undertaken a program for clearance and
reconstruction of the waterfront area (the previous Otis Elevator property,
now known as “I-Park”) in accordance with the Urban Renewal Plan for
N.P.D. 4 dated May 31, 1972, as amended November 1982 (the “I-Park
Urban Renewal Plan”); and
WHEREAS, Hudson View Associates, LLC, having an office at 485
West Putnam Avenue, Greenwich, Connecticut 06830 (the “Company”),
submitted to the Agency a Redeveloper’s Statement for Public Disclosure
and Redeveloper’s Statement of Qualifications and Financial
Responsibility (Form HUD-6004) pertaining to the redevelopment of a
portion of a parcel owned by the Agency in the I-Park Urban Renewal
Area and located in Section 2, Block 2015, Lot 95 on the Tax Map of the
City of Yonkers, being tentatively described as “a portion of Lot 95 at its
intersection with Ashburton Avenue to a point approximately 100 feet
south of the existing access driveway to the parking deck of the proposed
building (hereinafter referred to as the “Northern Portion of the CDA
Parcel)” to be conveyed to the Company in connection with its
construction of an approximate 100,000 square-foot office building to be
leased on a long-term basis to the County of Westchester for
administrative offices (the “Project”); and
WHEREAS, in further consideration for the disposition and
redevelopment of the Northern Portion of the CDA Parcel, the company
has agreed to convey to the City of Yonkers

WHEREAS, in accordance with Resolution No. 4-2006 adopted by
the Agency on February 14, 2006, the Agency caused to be published in
an eighteen-foot right-of-way on Ashburton Avenue owned by the
Company, for the purpose of performing a certain road widening project of
the City (the “Ashburton Parcel”); and the Journal News on March 8, 2006,
a Notice of Public Disclosure stating that the Redeveloper’s Statement for
Public Disclosure and Redeveloper’s Statement of Qualifications and
Financial Responsibility (Form HUD-6004) pertaining to the
redevelopment of the Project are available for public examination; and
WHEREAS, by Resolution No. 20-2006 adopted by the Agency on
June 22, 2006 in accordance with subsections (c) and (d) of Subdivision 2
in Section 507 of the General Municipal Law, the Agency designated the
Company, or an entity created, affiliated or related to the Company, as a
qualified and eligible sponsor for redevelopment of the Northern Portion of
the CDA Parcel and the Project subject to City Council approval, for a
period not to exceed six months from the date of City Council approval;
and
WHEREAS, on or about March 14, 2006, the Planning Board of the
City of Yonkers circulated its notice of intent to serve as lead agency
pursuant to the State Environmental Quality Review Act (“SEQRA”)
together with an EAF Part 1 regarding the “Proposed County
Administrative Building and Parking Structure” to be located at 10
Woodworth Avenue, also known as iPark frontage on Warburton Avenue,
Block 2015 Lot 100; and
WHEREAS, having received no challenges to its intent to act as
SEQRA lead agency, the Planning Board made a negative determination
of significance in accordance with SEQRA for the Project, which project
includes the Northern Portion of the CDA Parcel; and
WHEREAS, the road widening to affect the Ashburton Parcel was
addressed in the April 26, 2006 SEQRA Statement of Findings of the
Agency in connection with the Ashburton Avenue Urban Renewal Plan
and Master Plan; and
RESOLUTION (CONTINUED)
WHEREAS, in accordance with Resolution No. 2-2007 adopted by
the Agency on February 15, 2007, the Agency approved, subject to City
Council approval, a proposed land disposition agreement (the
“Agreement”) between the Agency and the Company which contemplates
the disposition of the Northern Portion of the CDA Parcel to the Company
in accordance with the provisions of subsection (d) of subdivision 2 in
Section 507 of the General Municipal Law of the State of New York, and in
accordance with Section 556 of said General Municipal Law; and
WHEREAS, the proposed Agreement, accompanied by a Summary
of the Principal Terms thereof, including the purchase price, attached
hereto as Exhibit “A” has been reviewed and considered by the Agency
and the City Council, and such summary has been published in The
Journal News on March 21,2008, and a public hearing on the disposition
of the Northern Portion of the CDA Parcel has been held by the City
Council in accordance with the provisions of subsection (d) of subdivision
2 in Section 507 of the General Municipal Law of the State of New York,
and in accordance with Section 556 of said General Municipal Law,
NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL
OF THE CITY OF YONKERS:
Section 1. That the designation of Harbor View Associates, LLC,
or an entity created, affiliated or related to the Company, as a qualified
and eligible sponsor is hereby approved for redevelopment of lands (or
portions thereof) in the I-Park Urban Renewal Area, including the Northern
Portion of the CDA Parcel which is located in Section 2, Block 2015, Lot
95 of the Tax Map of the City of Yonkers, and such designation shall
terminate upon the expiration of a period of six (6) months following the
date of this approval, unless prior to such expiration date, a land
disposition agreement and other disposition documents are executed by
all necessary parties.
Section 2. That the terms and conditions of the proposed
Agreement with the Company, or an entity created by, related to or
affiliated with the Company, for the redevelopment of the Northern Portion
of the CDA Parcel are hereby approved and the purchase price, the
acquisition of the Ashburton Parcel for a road-widening project, and other
terms and conditions, all as set forth in Exhibit “A” attached to this
Resolution are hereby found satisfactory and are approved.

Section 3. That the disposition of the Northern Portion of the
CDA Parcel to the Company is hereby approved subject to the terms and
conditions set forth in the Agreement, together with such changes as the
Chairman of the Agency may, on the advice of counsel, deem appropriate
and consistent with this resolution.
Section 4. That this resolution shall take effect immediately.

Hudson View Associates, LLC
SUMMARY OF PRINCIPAL TERMS
OF LAND DISPOSITION AGREEMENT
a. Project. The northern portion of certain urban renewal
property owned by CDA and located in Section 2, Block 2015, Lot 95 (the
“Subject Property”) is to be conveyed by deed from the CDA to Hudson
View Associates, LLC (the “Company”), or an entity created, affiliated or
related to the Company upon the substantial completion of the following
project: the Subject Property and properties previously acquired by the
Company and located in Section 2 , Block 2015, Lot 100of the Tax Map of
the City of Yonkers, to be developed as an 100,000 square foot office
building and a parking deck which will be subject to a long-term lease by
the Company to the County of Westchester for administrative offices (the
“Project”).
b. Firm Commitment Letter. Within 90 days after the City
Council approves the Planning Board decision for the Project, the
Company will provide a firm commitment letter from a lender to finance the
Project. Subject to Unavoidable Delays, if the Company fails to obtain the
firm commitment letter from a lender, the Agreement will be terminated.
c. Closing Date. The Closing of title to the Subject Property
is to occur within 30 days of the Substantial Completion Date but not later
than the date of Final Completion of the Project .
d. Purchase Price. The Purchase Price for the Subject
Property is $80,000 together with a deed from the Company for the
Ashburton Avenue Parcel. Upon the delivery of the deed for the Subject
Property, the Company agrees to convey title to the Ashburton Avenue
Parcel (described below) to the City, at no cost.
Ashburton Avenue Parcel. Eighteen-foot right-of- way on
Ashburton Avenue for the purpose of performing a certain road
widening project of the City.
e. Planning Board/SEQRA. The Company, at its sole cost
and expense, will undertake all studies and applications required under
SEQRA and the Zoning Ordinance in connection with the requirements for
the Project, and will make any changes to the development plans which
are consistent with the terms of the Agreement and are reasonably
required by the Planning Board for the purposes of the approvals of the
Planning Board and the City Council. The Company further agrees that no
design modifications shall be made to the exterior of the building without
prior written approval from the Agency, which approval shall not be
unreasonably conditioned, delayed or withheld.
f. Infrastructure. The Company will pay for the infrastructure
and environmental remediation. Construction of the Project will
commence under the license provisions of Article XV of the Agreement
and if the Company is in default under the Agreement, the CDA will not
convey title to the Subject Property to the Company.
g. Full Real Estate Taxes. The Company will be required to
pay full real estate taxes on the Project and will not utilize any exemption
or payment-in-lieu -of-tax benefits.

MINORITY LEADER McLAUGHLIN, COUNCILMEMBERS, McDOW,
GRONOWSKI, MURTAGH AND BARBATO:
WHEREAS, HUDSON VIEW ASSOCIATES, the developer for
property known as the 10 Woodworth Avenue, more properly known as
Block 2011, Lot 1, Block 2015, Lot 100 and Block 2015, Lot 95 on the Tax
Assessment Map of the City of Yonkers has submitted an application for a
Special Use Permit to the City Council for said property for redevelopment
in accordance with Article VII and Article IX of the Zoning Code of the City
of Yonkers; and
WHEREAS, said application has previously been submitted to the
Planning Board of the City of Yonkers for its approval, and, after several
hearings, such approval has been granted; and
WHEREAS, upon review of the application and the record, this City
Council believes it to be in the best interest of the City to grant said
application.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the
City of Yonkers, in meeting assembled that the proposed Special Use
Permit should be granted; and be it further;
RESOLVED, that upon the record and findings of the Planning
Board with respect to the application submitted by STEVE PUSTOLA and
LYNN WARD on behalf of the developer for a Special Use Permit and for
Site Plan Review at Block 2011, Lot 1 Block 2015, Lot 100 and Block
2015, Lot 95 on the property known as 10 Woodworth Avenue, pursuant
to Article VII and IX of the Zoning Code of the City of Yonkers. The
decision and actions of the Planning Board of the City of Yonkers are
hereby approved, subject to the conditions set forth in the decision of the
Planning Board, such as but not limited to the following conditions, stated
in said decision, such as (1) The office building loading zones are to be in
the rear of the site, facing the court yard area of the building in iPark and
no loading will be allowed from Warburton Avenue. Loading and deliveries
of any sort and all trash removal will not be permitted from Warburton
Avenue and through the front door of the building due to impacts on
Warburton Avenue traffic.

(2) The applicant will forward for the City of Yonkers plans for the
Planning Director’s approval indicating the exact location for loading via a
common area in the existing fence. (3) The existing fence on Warburton
Avenue will be maintained and repaired where necessary.
The existing landscaping on Lot 95 will also be maintained in it current
form. (4) The proposed building will be constructed from the rear of the
site and no construction access will be permitted via Warburton Avenue
without the express permission of the Planning Board after review by the
Board. (5) Parking stall sizes and alignments as well as aisle width and
alignments may be altered with the approval of the City of Yonkers traffic
Engineer and the Planning Director to accommodate the placement of
columns. The traffic Engineer has discussed this issue with the Planning
Bureau staff and believes that the low turnover nature of the parking
structure allows for small deviations from the strict requirements of the
zoning ordinance. (6) No signage will be permitted beyond that shown on
the submitted plans and approved with the current application without the
prior review of the Planning Board. (7) No changed to the façade materials
or colors shall be permitted without the prior approval of the Planning
Board. (8) All approvals granted by the Planning Board and any conditions
attached to their approval shall remain in full force and effect for the life of
the use.

Six Hundred Seven Dollars and Thirty-Three cents ($607.33) of the action
entitled, “Manuel A. OBalde, (residing at 456 Marlborough Road, Yonkers,
New York, 10701), Plaintiff against THE CITY OF YONKERS, Defendant",
for property damage arising out of an incident alleging that on December
16, 2007, at approximately 11:00 am, a City of Yonkers vehicle hit the
plaintiff’s vehicle at Tuckahoe Road and Mile Square Road in Yonkers, be
and the same hereby is approved and the Comptroller of the City of
Yonkers is directed to draw his warrant in the amount of Six Hundred

WHEREAS, included in the City Council’s 2006 State Legislative
Priorities packet is a request to amend the Public Authorities Law by
adding a new Section, Section 354-a, which will require the New York
state Thruway Authority to discontinue and remove the Yonkers toll plaza
located on the New York State Thruway either completely or for
passenger cars only, and
WHEREAS, in recent years we have seen how the removal of the
Spring Valley toll plaza has aided in the flow of passenger car traffic
through this area, and
WHEREAS, with approximately the same amount of traffic passing
through the Yonkers toll plaza, this area is experiencing the same traffic
impediments and delays that were experienced prior to the discontinuation
and removal of the Spring Valley toll plaza, and
WHEREAS, by facilitating travel between lower Westchester
County and Rockland County, in addition to removing the impediment to
the flow of traffic and, thereby, aiding residents in both Counties, the
removal of the Yonkers toll plaza will undoubtedly have a positive impact
not only on the Austin Avenue shopping complex in Yonkers, but also on
the Palisades Mall in West Nyack, and
WHEREAS, to accomplish this, A1555 sponsored by Assemblyman
Brodsky and S3181 sponsored by Senator Stewart-Cousins, is supported
by the Yonkers City Council.
BE IT FURTHER RESOLVED, that the Council requests the
passage of said legislation and, further requests that Governor Spitzer,
upon his review, sign the measure into law, and

The DEIS was submitted by the Applicant (Struever Fidelco Cappelli LLC (SFC)) in connection with the proposed redevelopment by the Applicant of 28.9 acres of land in downtown Yonkers, NY. The City Council accepted the DEIS as complete on March 18, 2008.

Public hearings will be held on the DEIS in the Yonkers City Council Chambers at 6:30 p.m. on April 29, 2008. Written comments on the DEIS will be accepted by the City Council until May 13, 2008 following the close of the hearing and should be addressed to the Lead Agency contact referred to below.

Name of Action: River Park Center, Cacace Center, Larkin Plaza, and Palisades Point

Description of the Proposed Project:

The Applicant, Struever Fidelco Cappelli LLC (“SFC”), is proposing the redevelopment of several underutilized parcels in and around Downtown Yonkers and its Hudson River waterfront. As proposed, the project would create new residential, retail, office, recreational, and open space uses in the four development areas. The primary development components of the proposal include the River Park Center, Cacace Center, Larkin Plaza, and Palisades Point. The application/petition of SFC as submitted to the Yonkers City Council on October 24, 2006 provides a detailed description of the location and build program for each project component, as well as a description of the anticipated related actions.

The proposed project would also include a number of improvements associated with the redevelopment such as new parking structures, amenities associated with re-exposing the Saw Mill River, and various public improvements outside the immediate redevelopment sites associated with necessary transportation and infrastructure improvements.

In addition to the development actions, the proposed project would include a number of related actions that would be discussed and analyzed in the DEIS. These actions include zoning amendments, amendments to urban renewal plans that affect redevelopment of the area, discontinuation of streets, alienation of city parkland, and numerous other approvals from various City, county, state, and, possibly, federal agencies. As proposed, the project includes the adoption of a Municipal Redevelopment Plan in accordance with New York Municipal Redevelopment Law to facilitate the issuance of tax increment bonds (“TIF” bonds) by the City of Yonkers intended to finance certain aspects of the proposed project.

Real Estate Committee Meeting Thursday at 7:00pm

Please be advised that a Real Estate Committee Meeting has been scheduled for Thursday, April 3, 2008 at 7:00 PM in the Council Chambers, City Hall, 4th Floor.

The following items will be on the Agenda:

1. Resolution - approving the recommendation of the Landmarks Preservation Board and designating the Philipse Manor Historic District as a Landmark Pursuant to Section 45-5 of the Code of the City of Yonkers.

2. Any additional items that may properly come before this Committee.

We ask the Administration to please have the appropriate Commissioners/Departments Heads/Directors or their representatives attend the meeting so they can address issues relating to their departments.
