RESOLUTION
1. BY: COUNCIL PRESIDENT LESNICK, MAJORITY LEADER ANNABI,
MINORITY LEADER McLAUGHLIN, COUNCILMEMBERS McDOW,
GRONOWSKI, MURTAGH AND BARBATO:
Resolution resubmitting a Home Rule Message to the New York
State Legislature in support of Assembly Bill Number A8021 (Pretlow) and
State Senate Bill S-4802 (Cousins) to amend the retirement and social
security law in relation to the retirement of detention officers employed by
the City of Yonkers.
WHEREAS, the Yonkers Detention Officers are a small unit
comprised of 23 officers, supervisors included that are Peace Officers who
supervise and maintain order in Yonkers Penal holding facilities, and
WHEREAS, while Detention Officers in Yonkers complete tasks
similar to what Police Officers complete in other municipalities, they do not
have similar retirement benefits, and
WHEREAS, New York State Bill Numbers A8021 (Pretlow) and
S4802 (Cousins) would amend the retirement and social security law and
grant Detention Officers employed by the city of Yonkers or those
employees that hold a job with responsibilities similar to those of a
detention officer, in the event that the job title of detention officer shall be
abolished, retirement benefits after twenty-five years of total creditable
service by filing an application, and
WHEREAS, upon retirement, each such Detention Officer shall
receive a pension which, together with an annuity which shall be the
actuarial equivalent of his or her accumulated contributions at the time of
his or her retirement and an additional pension which is the actuarial
equivalent of the reserved- for-increased-take-home-pay to which he or
she May then be entitled shall be sufficient to provide him or her with a
retirement allowance equal to one-half of his or her final average salary
WHEREAS, this legislation was place in Civil Service and Pensions
on April 27, 2009 through corresponding Senate sponsor number, which
was recently released as S4802 (Cousins) and

NOW, THEREFORE BE IT RESOLVED, that the City Council
hereby resubmits this Home Rule Message to the New York State
Legislature in support of Assembly Bill Number A8021 (Pretlow) and State
Bill Number S-4802 (Cousins) to amend the related general municipal law
to include retirement benefits for Yonkers Detention Officers.
BE IT FURTHER RESOLVED, that the City Council directs the
City Clerk to forward certified copies of this Home Rule Message to the
Yonkers delegation to the New York State Legislature.

The City of Yonkers, in City Council convened, hereby ordains and
enacts:
Section 1. Permission is hereby granted to the property owner of
445 & 449 PALMER ROAD , Block 5468, Lots 16 & 18 to make a multiple
house sanitary sewer connection from said lot to a city sanitary sewer in
Bryn Mawr Place at his own cost and expense and in accordance with the
plan submitted by MICHAEL McGARVEY P.E #74434 dated APRIL 16,
2009 filed in the Plumbing Division, subject to the conditions of a
Plumbing Permit to be secured from the Plumbing Division and a street
opening permit to be secured from the City Engineer.
Section 2. This permission is granted under the following terms and
conditions, to wit:
The granting of this permission shall, in no way, free or release the
said owner, or his successors, from the payment of any assessments or
benefits accruing to said lot by reason of the construction of any sanitary
sewer already built, or that hereafter shall be built, to serve the area within
which the lot herein referred to is located.
The cost of construction, maintenance and repairs of said long
house connection shall be the responsibility of the owner of the building
served by the long house connection.
Section 3. This ordinance shall take effect immediately.

BUDGET FOR FISCAL YEAR 2008/2009.
The City of Yonkers hereby ordains and enacts:
Section 1: The City’s Grant Budget for fiscal year 2008/2009 is
hereby amended by increasing revenues and appropriations for the Traffic
Engineering Department for a grant from N.Y.S. DOT & Federal Economic
Recovery Stimulus Funds, for purpose of upgrading existing traffic Signals
through out the City.
Increase Estimated Revenues

Increase Appropriation

Section 2: The unencumbered balance of such appropriation
equals or exceeds the estimated expenditures the City requires for such

RESOLUTION AUTHORIZING TRAFFIC SIGNAL UPGRADES FOR THE
CITY OF YONKERS - WESTCHESTER COUNTY – STIMULUS
PROJECT
WHEREAS, the upgrade of existing Traffic Signals identified PIN
8760.59, an Economic Recovery Project (the “Project) in the City of
Yonkers, Westchester County is eligible for funding under Title 23 U.S.
Code, as amended, that calls for the apportionment of the costs of such
program to be borne at the ratio of 100% Federal funds and 0% nonfederal
funds, and
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Yonkers being duly convened, does hereby approve the abovesubject
project; and be it further
RESOLVED, that the City Council hereby agrees to advance the
Project through the City’s resources and agrees and hereby authorizes the
City of Yonkers to pay in the first instance 100% of the federal and nonfederal
share of the cost of any and all phases or portions thereof; and be
it further
RESOLVED, that the sum of City of Yonkers makes a 100%
commitment of the non-federal share (if any) of the costs of the
Construction/Construction Inspection phases of the work for the Project or
portions thereof, with the Federal share of such cost to be applied directly
by the New York State Department of Transportation (“NYSDOT”)
pursuant to the State/Local agreement; and be it further
RESOLVED, that the sum of $1, 000,000 is hereby appropriated
from Account Number 049-G09-1509-1502 and made available to cover
the costs of participation to complete the Project including all phases or
portions thereof; and be it further
RESOLVED, that upon the completion of the construction of the
Project, or a fully usable portion thereof, the City of Yonkers agrees to
maintain the Project, or fully usable portions thereof, at its own sole cost
and expense; and be it further

RESOLVED, that in the event the full federal and non-federal

authorized to execute all necessary Agreements, certifications or
reimbursement requests for Federal Aid and providing for the
administration of the project and the municipality’s first instance funding of
project costs and permanent funding of the local share of federal-aid and
state-aid eligible Project costs and all Project costs within appropriations
therefore that are not so eligible, and be it further
RESOLVED, that a certified copy of the resolution be filed with the
New York State Commissioner of Transportation by attaching it to any
necessary Agreement in connection with the Project, and be it further
RESOLVED, that this resolution shall take effect immediately.

That the settlement by the Corporation Counsel in the amount of
TWO THOUSAND TWO DOLLARS AND 29/100 ($2,002.29) of the action
entitled, “JAMES LOFTUS (residing at 394 Palmer Road, Yonkers, NY
10701) plaintiff, against THE CITY OF YONKERS, Defendant", for
property damage arising out of an incident on the 21st day of February,
2008, in which plaintiff alleges they sustained damage to their vehicle in a
motor vehicle accident at the intersection of Mile Square Road and The
Crossway in the City of Yonkers, when it was struck by a DPW vehicle
owned by the City of Yonkers , be and the same hereby is approved and
the Comptroller of the City of Yonkers is directed to draw his warrant in the
amount of TWO THOUSAND TWO DOLLARS AND 29/100 ($2,002.29) in
favor of said plaintiff and their attorneys, Ross & Suchoff, LLC, 60 East
42nd Street, Suite 1545, New York, New York 10165.

OF YONKERS, Defendant”, for property damage arising out of an incident
on January 24, 2008 when a fire truck owned by the City of Yonkers struck
claimant’s vehicle which was parked and unoccupied in front of 21
Frances Terrace in the City of Yonkers, be and the same hereby is
approved and the Comptroller of the City of Yonkers is directed to draw
his warrant in the amount of THREE THOUSAND EIGHTY-TWO AND

RESOLUTION APPROVING AN INTERMUNICIPAL AGREEMENT
BETWEEN THE CITY OF YONKERS AND THE COUNTY OF
WESTCHESTER FOR THE USE OF GUNSHOT
DETECTION/LOCATION EQUIPMENT TO BE INSTALLED IN
LOCATIONS WITHIN THE CITY OF YONKERS.
WHEREAS, the Westchester County Department of Public Safety,
in conjunction with the Police Department of the City of Yonkers, has been
researching various audio and video technologies to assist law
enforcement agencies in their investigation of incidents of gun violence;
and
WHEREAS, there are gunshot detection/location systems available
that involve the installation of acoustic sensors and closed circuit
television systems that provide detection, location and video surveillance
of a gunshot incident, and the use of these systems will enable a more
timely response by law enforcement personnel to locate gunshot
incidents; and
WHEREAS, the County of Westchester is willing to fund up to one
million, five hundred thousand ($1,500,000) dollars towards the installation
of one of these systems in the City of Yonkers by the vendor, pursuant to
an agreement, a copy of which is attached; and
WHEREAS, the County of Westchester now desires to enter into an
Intermunicipal Agreement with the City of Yonkers for the installation of
the aforesaid system at various locations within the City;
NOW, THEREFORE, BE IT RESOLVED, that the Intermunicipal
Agreement between the County of Westchester and the City of Yonkers
for the gunshot detection/location system is approved; and be it further
RESOLVED, that this resolution will take effect immediately.

RESOLUTION APPROVING STATE ASSISTANCE GRANT OF $45,000
TO THE CITY OF YONKERS FOR USE IN PLANNING THE HUDSONFULTON-
CHAMPLAIN QUADRICENTENNIAL.
WHEREAS, the Office of Downtown Development is applying to
the New York State Department of Environmental Conservation, Office of
Management and Budget (hereinafter “DEC”) for a $45,000 State
Assistance Grant to fund the Hudson- Fulton-Champlain Quadricentennial
Program in accordance with the Hudson-Fulton-Champlain
Quadricentennial Act for various activities including the River Day
Celebration sponsored by the City of Yonkers; and
WHEREAS, these events may also include quality of life awareness
events, and entertainment and cuisine, and information and services on
important community programs ranging from health, education,
environmental and cultural opportunities for the betterment of the lifestyles
of the residents of the City as well as the Hudson area.
NOW, THEREFORE, BE IT RESOLVED, by the Yonkers City
Council, that it does hereby endorse and approve the application for a
$45,000 grant; and be it further,

A RESOLUTION TO ISSUE A DETERMINATION OF SIGNIFICANCE
PURSUANT TO THE STATE ENVIRONMENTAL QUALITY REVIEW ACT
(“SEQRA”) RELATING TO THE PROPOSED SALE OF CITY OWNED
PROPERTY, LOCATED AT 5-7 ORCHARD ST. TO HABITAT FOR
HUMANITY OF WESTCHESTER
WHEREAS, there is pending before the City Council, the proposed
purchase agreement with Habitat for Humanity for the sale of City owned
property located at 5-7 Orchard St., and described as Lots 21 and 22, at
Block 2079 of Section 2 on the Official Map of the City of Yonkers and,
WHEREAS, the City Council has determined that the proposed
lease and sale of property has been reviewed as an Unlisted Action under
the State Environmental Quality Review Act (“SEQRA”) requiring the City
Council to comply with the Regulations promulgated pursuant to SEQRA,
and
WHEREAS, the City Council has carefully considered the proposed
action and has reviewed the attached Environmental Assessment Form
and supplemental attachments and the criteria set forth in Section 617.7 of
6 NYCRR Part 617 of the SEQRA regulations and has identified and
carefully considered the relevant areas of environmental concern as are
fully set forth in said Environmental Assessment Form to determine if
these proposed actions will have a significant impact upon the
environment.
NOW, THEREFORE, BE IT RESOLVED by the Yonkers City
Council that based upon the City Council’s review of the Environmental
Assessment Form and supplemental attachments, and for the reasons set
forth therein, the City Council hereby adopts a Negative Declaration,

MEMBERS IN THE COMMUNITY WHO ARE AT RISK OF GETTING
LOST OR HURT DUE TO COGNITIVE OR MENTAL IMPAIRMENTS OR
DISORDERS.
WHEREAS, there are 438 medical conditions that cause cognitive
disorders and/or impairment, which affects people of all ages, nationalities
and social-economic groups; and
WHEREAS, these conditions put members in our community at risk
of wandering and possibly being seriously hurt or killed if not located
within 24 hours of the missing report.
WHEREAS, the City of Yonkers is calling upon our New York State
and Federal Delegation to enact a “Stay-Toone” program that will
specifically focus on the quality of life and safety of individuals that have
cognitive and mental disorders and not the age requirement associated
with current programs by providing GPS Bracelets; and
WHEREAS, “Program Lifesaver”, which is a pilot program of
Westchester County’s Departments of Public Safety and Senior Programs
and Services, and the Hebrew Home at Riverdale that helps monitor the
whereabouts of cognitively disabled individuals. It distributes a bracelet
with an electronic tracking device to seniors with Alzheimer’s and other
forms of dementia who may become confused and wander. If a senior
becomes lost, the transmitter bracelet can help the county police to quickly
locate the person; and.
WHEREAS, the name of the program is in honor of Ms. Toone who
is suffering with Alzheimer and was the driving force in recent legislation
being passed related to cognitive disorders after her encounter with Law
Enforcement; and

WHEREAS, knowing that time is of the essence for patients living
with cognitive disorders—be it dementia, Alzheimer’s disease or other
mental impairments—that may become lost or wander away, the “Stay-
Toone” initiative will assist Law Enforcement in immediately locating and
identifying these individuals; getting them the proper assistance they may
need and contacting their family’s accordingly.
THEREFORE BE IT RESOLVED, that the City Council of the City
of Yonkers calls upon our New York State and Federal Delegation to
enact a program, that will offer quick response and retrieval of individuals
with cognitive or mental impairments/disorders through the use of GPS
Bracelets; no matter their age, that may have wandered away or gotten
lost, through an operation called “Stay-Toone.
BE IT FURTHER RESOLVED, that the City Council directs the City
Clerk to forward copies of this Resolution to State and Federal Delegation.

WHEREAS, the Untermyer Performing Arts Council, will be holding
their “Hudson River Melodies” celebrating their 33rd year, which will run
from the last week in June, to end on September 5, 2009, and has
requested permission from the City Council to place banners throughout
the City promoting the event, and
WHEREAS, Untermyer Performing Arts Council has asked that
they be permitted to place five (5) banners at the following locations: (1)
on the Sadore Lane foot-bridge, Central Park Avenue; (2) the City Hall
foot-bridge, Nepperhan Avenue; (3) across Yonkers Ave. & Midland Ave.
(near Planet Fitness); (4) the area of North Broadway and DeHaven Drive
(in front of Untermyer Park);and (5) North Broadway & Executive Blvd. in
front of the Foxfire School, on or around June 17, 2009 and to be removed
as soon after September 5, 2009 as is possible.
NOW, THEREFORE BE IT RESOLVED, that the City Council of the
City of Yonkers hereby grants permission to Untermyer Performing Arts
Council to place five banners in the aforementioned locations, subject to
any terms and conditions deemed appropriate by the Administration to
protect the best interests of the City of Yonkers.

RESOLUTION
1. BY: COUNCIL PRESIDENT LESNICK, MAJORITY LEADER ANNABI,

Resolution resubmitting a Home Rule Message to the New York
State Legislature in support of Assembly Bill Number A8021 (Pretlow) and
State Senate Bill S-4802 (Cousins) to amend the retirement and social
security law in relation to the retirement of detention officers employed by
the City of Yonkers.
WHEREAS, the Yonkers Detention Officers are a small unit
comprised of 23 officers, supervisors included that are Peace Officers who
supervise and maintain order in Yonkers Penal holding facilities, and
WHEREAS, while Detention Officers in Yonkers complete tasks
similar to what Police Officers complete in other municipalities, they do not
have similar retirement benefits, and
WHEREAS, New York State Bill Numbers A8021 (Pretlow) and
S4802 (Cousins) would amend the retirement and social security law and
grant Detention Officers employed by the city of Yonkers or those
employees that hold a job with responsibilities similar to those of a
detention officer, in the event that the job title of detention officer shall be
abolished, retirement benefits after twenty-five years of total creditable
service by filing an application, and
WHEREAS, upon retirement, each such Detention Officer shall
receive a pension which, together with an annuity which shall be the
actuarial equivalent of his or her accumulated contributions at the time of
his or her retirement and an additional pension which is the actuarial
equivalent of the reserved- for-increased-take-home-pay to which he or
she May then be entitled shall be sufficient to provide him or her with a
retirement allowance equal to one-half of his or her final average salary
WHEREAS, this legislation was place in Civil Service and Pensions
on April 27, 2009 through corresponding Senate sponsor number, which
was recently released as S4802 (Cousins) and

to include retirement benefits for Yonkers Detention Officers.

Bryn Mawr Place at his own cost and expense and in accordance with the
plan submitted by MICHAEL McGARVEY P.E #74434 dated APRIL 16,

Plumbing Permit to be secured from the Plumbing Division and a street
opening permit to be secured from the City Engineer.
Section 2. This permission is granted under the following terms and
conditions, to wit:
The granting of this permission shall, in no way, free or release the
said owner, or his successors, from the payment of any assessments or
benefits accruing to said lot by reason of the construction of any sanitary
sewer already built, or that hereafter shall be built, to serve the area within
which the lot herein referred to is located.
The cost of construction, maintenance and repairs of said long
house connection shall be the responsibility of the owner of the building

hereby amended by increasing revenues and appropriations for the Traffic
Engineering Department for a grant from N.Y.S. DOT & Federal Economic
Recovery Stimulus Funds, for purpose of upgrading existing traffic Signals
through out the City.

RESOLUTION AUTHORIZING TRAFFIC SIGNAL UPGRADES FOR THE
CITY OF YONKERS - WESTCHESTER COUNTY – STIMULUS
PROJECT
WHEREAS, the upgrade of existing Traffic Signals identified PIN
8760.59, an Economic Recovery Project (the “Project) in the City of
Yonkers, Westchester County is eligible for funding under Title 23 U.S.
Code, as amended, that calls for the apportionment of the costs of such
program to be borne at the ratio of 100% Federal funds and 0% nonfederal
funds, and
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Yonkers being duly convened, does hereby approve the abovesubject
project; and be it further
RESOLVED, that the City Council hereby agrees to advance the
Project through the City’s resources and agrees and hereby authorizes the
City of Yonkers to pay in the first instance 100% of the federal and nonfederal
share of the cost of any and all phases or portions thereof; and be
it further
RESOLVED, that the sum of City of Yonkers makes a 100%
commitment of the non-federal share (if any) of the costs of the
Construction/Construction Inspection phases of the work for the Project or
portions thereof, with the Federal share of such cost to be applied directly
by the New York State Department of Transportation (“NYSDOT”)
pursuant to the State/Local agreement; and be it further
RESOLVED, that the sum of $1, 000,000 is hereby appropriated
from Account Number 049-G09-1509-1502 and made available to cover
the costs of participation to complete the Project including all phases or
portions thereof; and be it further
RESOLVED, that upon the completion of the construction of the
Project, or a fully usable portion thereof, the City of Yonkers agrees to
maintain the Project, or fully usable portions thereof, at its own sole cost
and expense; and be it further

reimbursement requests for Federal Aid and providing for the
administration of the project and the municipality’s first instance funding of

entitled, “JAMES LOFTUS (residing at 394 Palmer Road, Yonkers, NY
10701) plaintiff, against THE CITY OF YONKERS, Defendant", for
property damage arising out of an incident on the 21st day of February,
2008, in which plaintiff alleges they sustained damage to their vehicle in a
motor vehicle accident at the intersection of Mile Square Road and The
Crossway in the City of Yonkers, when it was struck by a DPW vehicle
owned by the City of Yonkers , be and the same hereby is approved and
the Comptroller of the City of Yonkers is directed to draw his warrant in the
amount of TWO THOUSAND TWO DOLLARS AND 29/100 ($2,002.29) in

RESOLUTION APPROVING AN INTERMUNICIPAL AGREEMENT
BETWEEN THE CITY OF YONKERS AND THE COUNTY OF
WESTCHESTER FOR THE USE OF GUNSHOT
DETECTION/LOCATION EQUIPMENT TO BE INSTALLED IN
LOCATIONS WITHIN THE CITY OF YONKERS.
WHEREAS, the Westchester County Department of Public Safety,
in conjunction with the Police Department of the City of Yonkers, has been
researching various audio and video technologies to assist law
enforcement agencies in their investigation of incidents of gun violence;
and
WHEREAS, there are gunshot detection/location systems available
that involve the installation of acoustic sensors and closed circuit
television systems that provide detection, location and video surveillance
of a gunshot incident, and the use of these systems will enable a more
timely response by law enforcement personnel to locate gunshot
incidents; and
WHEREAS, the County of Westchester is willing to fund up to one
million, five hundred thousand ($1,500,000) dollars towards the installation
of one of these systems in the City of Yonkers by the vendor, pursuant to
an agreement, a copy of which is attached; and
WHEREAS, the County of Westchester now desires to enter into an
Intermunicipal Agreement with the City of Yonkers for the installation of
the aforesaid system at various locations within the City;
NOW, THEREFORE, BE IT RESOLVED, that the Intermunicipal
Agreement between the County of Westchester and the City of Yonkers
for the gunshot detection/location system is approved; and be it further
RESOLVED, that this resolution will take effect immediately.

CHAMPLAIN QUADRICENTENNIAL.
WHEREAS, the Office of Downtown Development is applying to
the New York State Department of Environmental Conservation, Office of
Management and Budget (hereinafter “DEC”) for a $45,000 State
Assistance Grant to fund the Hudson- Fulton-Champlain Quadricentennial
Program in accordance with the Hudson-Fulton-Champlain
Quadricentennial Act for various activities including the River Day
Celebration sponsored by the City of Yonkers; and
WHEREAS, these events may also include quality of life awareness
events, and entertainment and cuisine, and information and services on
important community programs ranging from health, education,
environmental and cultural opportunities for the betterment of the lifestyles
of the residents of the City as well as the Hudson area.
NOW, THEREFORE, BE IT RESOLVED, by the Yonkers City
Council, that it does hereby endorse and approve the application for a
$45,000 grant; and be it further,

A RESOLUTION TO ISSUE A DETERMINATION OF SIGNIFICANCE
PURSUANT TO THE STATE ENVIRONMENTAL QUALITY REVIEW ACT
(“SEQRA”) RELATING TO THE PROPOSED SALE OF CITY OWNED
PROPERTY, LOCATED AT 5-7 ORCHARD ST. TO HABITAT FOR
HUMANITY OF WESTCHESTER
WHEREAS, there is pending before the City Council, the proposed
purchase agreement with Habitat for Humanity for the sale of City owned
property located at 5-7 Orchard St., and described as Lots 21 and 22, at
Block 2079 of Section 2 on the Official Map of the City of Yonkers and,
WHEREAS, the City Council has determined that the proposed
lease and sale of property has been reviewed as an Unlisted Action under
the State Environmental Quality Review Act (“SEQRA”) requiring the City
Council to comply with the Regulations promulgated pursuant to SEQRA,
and
WHEREAS, the City Council has carefully considered the proposed
action and has reviewed the attached Environmental Assessment Form
and supplemental attachments and the criteria set forth in Section 617.7 of
6 NYCRR Part 617 of the SEQRA regulations and has identified and
carefully considered the relevant areas of environmental concern as are
fully set forth in said Environmental Assessment Form to determine if
these proposed actions will have a significant impact upon the
environment.

TO ADOPT LEGISLATION THAT WILL OFFER GPS BRACELETS TO
MEMBERS IN THE COMMUNITY WHO ARE AT RISK OF GETTING
LOST OR HURT DUE TO COGNITIVE OR MENTAL IMPAIRMENTS OR
DISORDERS.
WHEREAS, there are 438 medical conditions that cause cognitive
disorders and/or impairment, which affects people of all ages, nationalities
and social-economic groups; and
WHEREAS, these conditions put members in our community at risk
of wandering and possibly being seriously hurt or killed if not located
within 24 hours of the missing report.
WHEREAS, the City of Yonkers is calling upon our New York State
and Federal Delegation to enact a “Stay-Toone” program that will
specifically focus on the quality of life and safety of individuals that have
cognitive and mental disorders and not the age requirement associated
with current programs by providing GPS Bracelets; and
WHEREAS, “Program Lifesaver”, which is a pilot program of
Westchester County’s Departments of Public Safety and Senior Programs
and Services, and the Hebrew Home at Riverdale that helps monitor the
whereabouts of cognitively disabled individuals. It distributes a bracelet
with an electronic tracking device to seniors with Alzheimer’s and other
forms of dementia who may become confused and wander. If a senior
becomes lost, the transmitter bracelet can help the county police to quickly
locate the person; and.
WHEREAS, the name of the program is in honor of Ms. Toone who
is suffering with Alzheimer and was the driving force in recent legislation
being passed related to cognitive disorders after her encounter with Law
Enforcement; and

WHEREAS, knowing that time is of the essence for patients living
with cognitive disorders—be it dementia, Alzheimer’s disease or other
mental impairments—that may become lost or wander away, the “Stay-
Toone” initiative will assist Law Enforcement in immediately locating and
identifying these individuals; getting them the proper assistance they may
need and contacting their family’s accordingly.
THEREFORE BE IT RESOLVED, that the City Council of the City
of Yonkers calls upon our New York State and Federal Delegation to
enact a program, that will offer quick response and retrieval of individuals
with cognitive or mental impairments/disorders through the use of GPS
Bracelets; no matter their age, that may have wandered away or gotten
lost, through an operation called “Stay-Toone.
BE IT FURTHER RESOLVED, that the City Council directs the City
Clerk to forward copies of this Resolution to State and Federal Delegation.

WHEREAS, the Untermyer Performing Arts Council, will be holding
their “Hudson River Melodies” celebrating their 33rd year, which will run
from the last week in June, to end on September 5, 2009, and has
requested permission from the City Council to place banners throughout
the City promoting the event, and
WHEREAS, Untermyer Performing Arts Council has asked that
they be permitted to place five (5) banners at the following locations: (1)
on the Sadore Lane foot-bridge, Central Park Avenue; (2) the City Hall
foot-bridge, Nepperhan Avenue; (3) across Yonkers Ave. & Midland Ave.
(near Planet Fitness); (4) the area of North Broadway and DeHaven Drive
(in front of Untermyer Park);and (5) North Broadway & Executive Blvd. in
front of the Foxfire School, on or around June 17, 2009 and to be removed
as soon after September 5, 2009 as is possible.
NOW, THEREFORE BE IT RESOLVED, that the City Council of the
City of Yonkers hereby grants permission to Untermyer Performing Arts
Council to place five banners in the aforementioned locations, subject to
any terms and conditions deemed appropriate by the Administration to
protect the best interests of the City of Yonkers.

After an extraordinarily long session with a failed attempt to drive the community’s rezoning proposal back to committee followed by a failed attempt to “carve out” two property owners the City Council voted 5 – 2 in favor of the proposal to rezone Upper Warburton Avenue high rise to garden apartments.

Real Estate Committee Meeting Tuesday, June 9, 2009 at 6:00 PM
The following items will be on the Agenda:
1. Resolution – to issue a determination of significance pursuant to the State Environmental Quality Review Act (“SEQRA”) relating to the proposed sale of City owned property, located at 5-7 Orchard St. to Habitat for Humanity of Westchester.
2. Resolution – to authorize the sale of real property located at 5-7 Orchard Street – Section 2, Block 2079, Lots 21 and 22 to Habitat for Humanity.
3. SFC Proposed Development Project:
1. Resolution – approving a Planned Urban Redevelopment Plan Special Use Permit on Properties known as Parcels H and I of the Yonkers Waterfront, Block 640, Lots 1, 25 and 38 and Block 643, Lots, 1, 24 and 40 pursuant to Article VII of the Yonkers Zoning Code.
2. Resolution - approving the Land Disposition Agreement between the City Of Yonkers, The Yonkers Community Development Agency, The City of Yonkers Industrial Development Agency, The Yonkers Economic Development Corporation, The New Main Street Development Corporation and Struever Fidelco Capelli LLC.
4. Any additional items that may properly come before this Committee.

General Ordinance – amending General Ordinance No. 24-1968 as readopted, confirmed, reenacted and reaffirmed by General Ordinance No. 39-1970 (commonly known as The Zoning Ordinance of the City of Yonkers) and the zoning map by amending said map by changing the zone classification of block 3570, lots 1-20 also known as 1167-1205 Warburton Avenue and all lots in blocks 3610 and 3615, from its present “A” zone district classification to a “MG” zone district.
