RESOLVED, by the City Council of the City of Yonkers, in meeting
assembled:
That the settlement by the Corporation Counsel in the amount of ONE
THOUSAND THREE HUNDRED FORTY-ONE and 53/100 DOLLARS
($1,341.53) of the Loss-Transfer proceeding entitled, "AMICA MUTUAL
INSURANCE COMPANY A/S/O SOPHIE LEHR, residing at 65 Darling
Avenue, New Rochelle, New York 10804, plaintiff, against THE CITY OF
YONKERS, Defendant", for reimbursement of no-fault benefits paid to its
insured arising out of an incident in which it is alleged that a Department of
Public Works Elgin street sweeper owned by the City of Yonkers, while
proceeding to the location where it was to commence its street sweeping
activities, crossed over the double yellow lines and struck plaintiff’s
subrogor’s oncoming vehicle, on Parkview Avenue near Cherokee Road in
the City of Yonkers on the 11th day of April, 2007, be and the same hereby
is approved and the Comptroller of the City of Yonkers is directed to draw
his warrant in the amount of ONE THOUSAND THREE HUNDRED
FORTY-ONE and 53/100 DOLLARS ($1,341.53) in favor of said plaintiff

RESOLUTION
5. BY COUNCIL PRESIDENT LESNICK, MAJORITY LEADER ANNABI,
MINORITY LEADER McLAUGHLIN, COUNCILMEMBERS McDOW,
GRONOWSKI, MURTAGH AND BARBATO:
WHEREAS, the Westchester County Department of Parks,
Recreation and Conservation through its “Legacy Program” will fund
municipalities which submit successful applications to construct ball fields
and active recreation facilities; and
WHEREAS, successful municipal applicants will be required to
enter into an Inter-Municipal Agreement with the County of Westchester;
and
WHEREAS, the Department of Parks, Recreation and
Conservation of the City of Yonkers, proposes to apply for funding to
construct a Skate Park at the E. J. Murray Memorial Skating Facility; and
WHEREAS, the potential grant funding available for these projects
is limited and other municipalities are eligible to apply for such funds under
the “Legacy Program” and recipients of such funding will not be required
to provide local matching funds; and
WHEREAS, the CITY OF YONKERS is hereby authorized to
execute such application(s) with the County of Westchester, in order to
provide such funds from the “Legacy Program” to the CITY OF YONKERS
and the Mayor or his designee is hereby designated the representative
authorized to act on behalf of the municipality in regard to the preparation
of the application for the municipality signature; and
NOW, THEREFORE BE IT RESOLVED, that the City of Yonkers is
hereby authorized to execute the application with the ‘Legacy Program’ for
the aforesaid purposes, with the total amount of the proposed award at
$250,000.00; and be it further;

6. BY COUNCIL PRESIDENT LESNICK, MAJORITY LEADER ANNABI,
MINORITY LEADER McLAUGHLIN, COUNCILMEMBERS McDOW,
GRONOWSKI, MURTAGH AND BARBATO:
WHEREAS, the County of Westchester desires to purchase and
then convey approximately 31, 568 square feet of real property located at
303-307 South Broadway, Yonkers, New York, in the City of Yonkers to
303 South Broadway Associates, LLC for the purpose of providing
affordable housing for a period of thirty years; and
WHEREAS, the City of Yonkers supports the development of
affordable housing on said property, subject to any applicable subdivision
requirements and waives any rights to purchase the property under the
following terms and conditions; (1) For use in perpetuity for park and
municipal recreation purposes for the sum of one dollar ($1.00).; (2) For
other municipal purposes at the current appraisal value as determined by
the Westchester County Board of Legislators, or for no more than the
same consideration for which it is proposed to be sold to 303 South
Broadway Associates, LLC, whichever is less. ; or (3) Any opportunity to
purchase this property shall not constitute a right to purchase and may be
withdrawn by the County at any time.
NOW, THEREFORE, BE IT RESOLVED, that the City of Yonkers
hereby declares its support for the aforesaid project, and be it further
RESOLVED, that the City of Yonkers hereby waives and
relinquishes any rights that the City may have under the aforesaid
opportunity to purchase said property located at 303-307 South Broadway,
Yonkers, New York; and be it further

7. BY COUNCIL PRESIDENT LESNICK, MAJORITY LEADER ANNABI,
MINORITY LEADER McLAUGHLIN, COUNCILMEMBERS McDOW,
GRONOWSKI, MURTAGH AND BARBATO:
WHEREAS, the City of Yonkers has established a Housing
Implementation Fund to provide infrastructure and other improvements to
encourage and support the development or preservation of affordable
housing;
WHEREAS, Loewen Development, or its successor proposes to
develop or preserve 86 affordable rental housing units and related
amenities in the development known as Broadway View, the “Project”; and
WHEREAS, in order to make the proposed development viable,
infrastructure must be constructed, including, but not limited to parking,
lighting, sidewalks, public sewer and water, storm water detention, the
“Infrastructure Improvements”, as id more fully set forth in a schedule of
work; and
WHEREAS, the proposed development requires the assistance
from the Westchester County Housing Implementation Fund, (“HIF”) to
subsidize the costs of the Infrastructure Improvements in order to assure
affordability of the units.
NOW, THEREFORE, BE IT RESOLVED, that the City of Yonkers is
hereby authorized to submit an application to Westchester County for a
Housing Implementation Fund Grant for the Project not to exceed
$4,000,000; and be it further
RESOLVED, that the City of Yonkers is authorized to enter into an
Intermunicipal Agreement (“IMA”) with Westchester County and take all
necessary steps to facilitate and implement the terms of the IMA and the
scope of work appended to such agreement; and be it further

WHEREAS, the Glenwood Power Station (Plant) has been the
source of numerous City Council Committee meetings, and
WHEREAS, the property owner and the community have
participated in these meetings, and
WHEREAS, these meetings have resulted in a productive dialogue
regarding the current condition and future of the Site, and
WHEREAS, the best way to ultimately reach a solution that serves
the interests of the owner and the community is to continue this dialogue,
NOW THEREFORE BE IT RESOLVED, by the City Council of the
City of Yonkers that all Council Correspondence and Official Documents
regarding the Glenwood Power Station (Plant) will only refer to the
premises as “The Glenwood Power Station (Plant)” or as to the premises

MINORITY LEADER McLAUGHLIN, COUNCILMEMBERS McDOW,
GRONOWSKI, MURTAGH AND BARBATO:
Whereas, Dominick J. Iannacone was born December 22, 1927, in
the City of Yonkers, New York and died, August 17, 2004, and
Whereas, Dominick J. Iannacone was dedicated to public service in and
for Yonkers, serving for many years in education in Yonkers public
schools and in public service for decades in both Westchester County and
Yonkers City government, and
Whereas, Dominick J. Iannacone served in the United States Navy
during the end of World War II, and
Whereas, Dominick J. Iannacone received a Bachelor of Science
Degree from Fordham University and a Master’s Degree in Education from
New York University, and
Whereas, Dominick J. Iannacone was a confirmed Democrat and
party activist who also was elected and served as a member of the
Westchester County Board of Supervisors from the 8th Ward (presently
the County Board of Legislators) from 1966-1967, and
Whereas, Dominick J. Iannacone served on the Yonkers City
Council and was the Councilman for the 8th Ward, rising to the post of
Vice Mayor of the City of Yonkers, and
Whereas, Dominick J. Iannacone was an employee of the Yonkers
Board of Education serving as a teacher and physical education coach at
Lincoln High School, a driver’s education instructor for Sacred Heart High
School, an Executive Director of the Yonkers Public Schools, as well as
holding various administrative posts in the Yonkers school system, and
Whereas, Dominick J. Iannacone additional served as Principal of
Yonkers High School from 1982 through 1985, and
Whereas, Dominick J. Iannacone love and dedication to the
educational school system in Yonkers led to his mayoral appointment to
the Board of Education of the City of Yonkers in 1995, and he served a full
term until the year 2000, and

Whereas, Dominick J. Iannacone was one of the driving forces
behind choosing the name “Yonkers Middle High School” in 1991, bringing
about the first time a high school was named for this City since 1988, and
Whereas, Dominick J. Iannacone was involved in many activities
such as being a Member of the Frank A. Rea Post, a Member of the
Rauso Post, Past Chairman of the Columbus Day Committee, Member of
the Enrico Fermi Educational Foundation and an avid golfer who enjoyed
traveling and playing golf worldwide, and
Whereas, after retiring from the educational field, Dominick J.
Iannacone, became the Facility Manager at Sprain Lake Golf Course, and
Whereas, Dominick J. Iannacone had election victories in 1966 for
supervisor, (County Legislator) and for Councilman in 1970 (a post he
held until 1977), and
Whereas, Dominick J. Iannacone lost to Angelo Martinelli in the
1977 Mayoral race and in 1989 he attempted to defeat Mayor Nicholas C
Wasicsko in a Democratic Primary, but lost to Wasicsko, who lost the
election to Hank Spallone, and
Whereas, Dominick J. Iannacone is survived by his beloved wife,
Mary Lucas, a son Norman, and three grandchildren, and
Whereas, Dominick J. Iannacone is predeceased by a son,
Stephen and two brothers, Vincent and Jack, and
Whereas, Dominick J. Iannacone’s wife Mary, family and all his
friends of more than 50 years, requested to have a small section of the
street, Glen Brook Avenue, where Dominick J. Iannacone lived with his
family be honorary renamed Iannacone Way or Brother Iannacone Way to
recognize the work that he accomplished during his lifetime, and
Whereas, Council Rules of January 2006 require a public hearing
take place for such a request, and
Now, therefore be it resolved, that the City Council of Yonkers
hereby directs the City Clerk to set a public hearing date for the
consideration of a street renaming for the late Dominick J. Iannacone.

BARBATO:
WHEREAS, the late Sidney A. Sadin was born May 19, 1918, and
passed on, October 8, 2005, and
WHEREAS, Sidney A. Sadin has resided at 20 Greystone Terrace
for over 20 years and has resided in the City of Yonkers for over 50 years,
and
WHEREAS, Sidney A. Sadin served in the United States Marines
during the end of the Korean War, as 1st Sergeant Marine for the Untied
States Forces, and
WHEREAS, Sidney A. Sadin joined the reserve for many years
under the same rank at the end of the Korean War, and
WHEREAS, Sidney A. Sadin took a career as a scientist and
chemist working for U.S. Vitamin in Yonkers, Revlon and Merck Company,
and
WHEREAS, during Sidney A. Sadin career as a scientist and
chemist, he contributed to developing special cement for hip surgery and
medical drugs and patents, and
WHEREAS, Sidney A. Sadin was involved in many activities within
the community and served as a member to the New York Chemical
Society, Smithsonian Institute and Honorary Member of National
Geographic, and
WHEREAS, Sidney A. Sadin was appointed as the Retiree Council
in West Point, where he also volunteered to work at the Keller Hospital
Pharmacy for 14 years, and
WHEREAS, Sidney A. Sadin is survived by his beloved wife, Sarah
Sadin, a two daughters, Roberta and Raquel, and four grandchildren, and

WHEREAS, St. John’s Episcopal Church, 100 Underhill Street in
the northeast section of Yonkers will hold their 2nd. Annual Green Day
Celebration on Saturday, September 20, 2008 from 10:00 am to 3:00 pm,
and St. John’s has requested permission from the City Council to hang a
banner promoting this event informing the public as to the details involved
with the Fair, and
WHEREAS, St. John’s Episcopal Church has asked for permission
to place the promotional banner on the Northbound overpass across
Central Park Avenue at Sadore Lane beginning September 1st for 3
weeks prior to the event, and to be removed as soon after September 20th
as possible.
NOW, THEREFORE BE IT RESOLVED, the City Council of
Yonkers hereby grants permission to St. John’s Episcopal Church to place
their banner at the aforementioned location, subject to any terms and
conditions deemed appropriate by the Administration to protect the best
interests of the City of Yonkers.

WHEREAS, in 1994, former President Bill Clinton signed into law
the resolution unanimously adopted by the U. S. Congress establishing
the fourth Sunday of every July as Parents' Day, a perennial day of
commemoration similar to Mother's Day and Father's Day; and
WHEREAS, according to the Congressional Resolution, Parents’
Day is established for "recognizing, uplifting, and supporting the role of
parents in the rearing of children”; and
WHEREAS, the City of Yonkers is proud of its many community
groups who play an integral leadership role in representing our
community; and
WHEREAS, foremost among these groups is the Hudson Valley
Parents’ Day Committee whose mission is to promote and uplift good
parenting as a central vocation for the realization of healthy families and
communities; and
WHEREAS, the Hudson Valley Parents’ Day Committee has
planned a Parents’ Day awards ceremony to honor parents who have
been positive role models; and
WHEREAS, this year the Hudson Valley Parents’ Day Committee
will host a Parents’ Day event in our City, sharing its proud mission with
all our residents on the 26th day of July 2008 honoring parents with an
“Excellence in Parenting” Award; and
WHEREAS, this event provides an opportunity for the Hudson
Valley Parents’ Day Committee to bestow well deserved honors upon
outstanding members of the community who have selflessly given of their
time, love and support of their families; and

WHEREAS, the City of Yonkers is blessed to claim among its
residents individuals who have accomplished much and done some
amazing things, and
WHEREAS, what can be more amazing than going into outer
space? Well, Yonkers is proud of Col. Ronald Garan, Jr., who recently
traveled to space on May 31, 2008, on the 35th Mission of the Space
Shuttle Discovery, and
WHEREAS, Col. Garan is a 1979 graduate of Roosevelt High
School in Yonkers, received his commission from the United States Air
Force in 1984, was deployed to Southwest Asia in support of Operations
Desert Shield & Desert Storm and was selected by NASA in 2000 for
training and missions, which has resulted in his current space expedition,
and
WHEREAS, Col. Garan is currently on board STS-1244 and has
served as Mission Specialist 2 for ascent and entry to perform three
spacewalks, to operate the space shuttle robotic arm and to assist in the
activation of the Kibo laboratory on the International Space Station, and
WHEREAS, another reason that Yonkers, Westchester and all of
New York State have to be proud of this space voyage and all of
Discovery’s missions is that the space shuttle itself was named in honor of
Henry Hudson’s quest for the Northwest Passage up the Hudson River,
and
WHEREAS, Col. Garan has been an esteemed member of the
Yonkers community, whose achievements will undoubtedly inspire young
men and women of Yonkers and throughout the United States to
accomplish much in their chosen fields and aspire to greater heights in
everything they desire to do.

GENERAL ORDINANCE
1. BY COUNCILMEMBER BARBATO; COUNCIL PRESIDENT LESNICK,

The City of Yonkers, in City Council convened, does hereby ordain and
enact:
Section 1.General Ordinance No. 4-2000 and the accompanying map,
also known as Chapter 43 of the Code of the City of Yonkers and more
commonly known as the Zoning Code of the City of Yonkers, is hereby generally
amended and revised in part as follows:
“Section 43-8 of the Code of the City of Yonkers entitled “Definition of Terms” is
hereby amended in part by the addition of the following terms to be placed in
alphabetical order within the section:
BASEMENT – The portion of a building that is partly or completely below grade.
A basement shall be counted as a story if the distance between the grade and
elevation to the floor immediately above equals or exceeds
a. More than 6 feet above grade elevation;
b. More than 6 feet above the finished grade elevation for more than fifty percent
(50%) of the total building perimeter; or
c. More than 12 feet above the finished ground level at any point (See Illustration
#4.)
Dormer - Any structure whose framing projects out of a sloping roof to form a
vertical wall suitable for windows or other openings.
Gross Floor Area
a) For detached single- and two-family homes - the sum of the
gross horizontal areas of the several floors and mezzanine floors of a building
and its accessory buildings on the same lot. All dimensions shall be measured
between exterior faces of walls.
b) For all other buildings - the sum of the gross horizontal areas of the several
floors and mezzanine floors of a building and its accessory buildings on the same
lot, excluding basement or cellar area devoted to parking and mechanical
equipment space. All dimensions shall be measured between exterior faces of
walls.”

Section 3. Section 43 – 34 of the Code of the City of Yonkers entitled
“Supplemental regulations for certain residential uses”, specifically, is hereby
amended in part by the addition of new section 43-34 (H) entitled “Detached
Single and Two –Family Dwellings” to read as follows:

(H) Detached Single- and Two-Family Dwellings: Detached single- and twofamily
dwelling in all residential districts shall be subject to the following
additional regulations:
a) Side Setback Plane. Except as provided in subsection B, below, an inwardly
sloping 45-degree angle side setback plane begins at a horizontal line 20-feet
directly above each side setback line. The 20-foot height of the horizontal line is
established for 40-foot deep portions of the lot beginning at the front setback line
and extending to the rear of the lot, except that the last portion at the rear of the
lot may be less than 40 feet deep. (see Illustration ). The side setback plane
may be rotated ninety degrees on the lot and provided as a front/rear set back
plane to accommodate alternative lot orientations. In such cases, no side setback
plane is required.
b) Exceptions to the side setback plane and rear setback plane requirements:
The requirements of the side and rear setback planes shall not apply to:
i) Dormers that do not exceed fifty (50) percent of the horizontal area of
the roof upon which they are located;
ii) Radio or television antennae
iii) Chimneys or vents
Provided that such features shall exceed the required plane only to the extent
necessary to accomplish the purpose for which they are intended to serve.
c) Side Wall Articulation. A side wall of a building that is more than 15 feet tall
and is an average distance of 15 feet or less from a side lot line may notextend in
an unbroken plane for more than 30 feet along a side lot line. To break the
plane, a wall articulation of not less than two (2) feet for a distance of not less
than ten (10) feet is required. (See Illustration ).
d) Maximum exposed wall height. The maximum exposed height of any wall of
a detached single- or two-family dwelling shall be 35 feet as measured from the
finished grade at the base of the wall to the eave.(See Illustration.)
e) Administrative relief permitted. The Commissioner of Housing and Buildings
shall have the power to grant, in a S-200, S-100, S-75, S-60, S-50, or a T zone,
a permit for alteration or extension not exceeding two thousand five hundred
(2,500) cubic feet to an detached single- or two-family dwelling, wherein front
yard, side yard, rear yard or FAR requirements are at variance with the
provisions of this chapter, provided that the applicant for such a permit shall file
with the Commissioner written and notarized consents for such alteration or
extension of the immediately abutting lot owners. The administrative relief shall
be specifically noted on the certificate of occupancy for the building and only one
such permit shall be granted. Any additional alterations or extensions in variance
with the zoning code may be granted only after compliance with Article VIII,
Variances, of the Yonkers Zoning Code.”

Section 1. Permission is hereby granted to PROPHET ELIAS
GREEK ORTHODOX CHURCH, as owner of 15 Leroy Avenue, Yonkers,
New York, Section 1, Block 52, Lots 24 & 26, to construct and maintain an
encroachment upon the City right-of-way located on Leroy Avenue in
accordance with and as shown on a survey to be approved by the City
Engineer and the Director of the Bureau of Housing and Buildings.
Section 2. This permission is granted subject to the following
terms and conditions, to wit:
(a) That the entire cost and expense of obtaining and thereafter
maintaining the encroachment on Leroy Avenue shall be paid by
the owner, its successor and/or assigns without expense to or
contribution by the City of Yonkers;
(b) That neither the approval of the above-referred survey by the
appropriate city official, nor the placement of any improvements by the
owner of 15 Leroy Avenue upon said encroachment shall be deemed a
waiver, or in any way affect the right, of the City of Yonkers to provide for
construction or otherwise improve its right-of-way; provided further that the
City of Yonkers reserves the right to assess the property benefited in like
manner and in like effect as if approval had not been given by the City of
Yonkers. That the granting of this permission shall in no way free or
release said owner or any successors or assigns from the payment of any
assessment hereafter imposed;
(c) That no permanent improvements will be allowed in the
encroachment area;
(d) That the owner, or its successor, assigns, and agents, shall
secure all necessary permits and consents and shall secure and maintain
a property damage and public liability insurance policy naming the City as
insured, or as an additional named insured in an amount and form

satisfactory to the City Engineer and the Corporation Counsel of the City
of Yonkers and provide the City with evidence thereof within fifteen (15)
days of approval of this encroachment;
(e) The City of Yonkers reserves the right to revoke or terminate this
permission for whatever reason, upon thirty (30) days written notice to the
owner, whenever it may deem such revocation necessary; Upon
revocation or termination of this permission, the owner, its successor or
assigns shall immediately remove any improvement placed within said
encroachment at the express direction of the City, and at the owner’s cost
and expense;
(f) That the owner, its successor or assigns shall, for whatever
period this permission remains in effect, save harmless and indemnify the
City of Yonkers for any and all claims, actions, suits, judgments, etc.
including all costs related to the defense thereof.
Section 3. This ordinance shall take effect immediately.

WHEREAS, in accordance with an agreement between the County
of Westchester and the City of Yonkers, the County of Westchester has
submitted a renewed agreement commencing January 1, 2008 and
terminating December 31, 2009 for the transportation of prisoners
between the City of Yonkers and the Westchester County Department of
Correction; and
WHEREAS, this agreement, a copy of which is attached, is
pursuant to Sections 500-c and 500-d of the Corrections Law of the State
of New York; and
NOW, THEREFORE, BE IT RESOLVED, that the Prisoner
Transportation Agreement between the County of Westchester and the
City of Yonkers for the transportation of prisoners between the City of
Yonkers and the Westchester County Department of Corrections for the
years 2008 through 2009 is hereby approved; and be it further
RESOLVED, that this resolution will take effect immediately.

5. BY COUNCIL PRESIDENT LESNICK, MAJORITY LEADER ANNABI,

WHEREAS, included in the City Council’s 2006 State Legislative
Priorities packet is a request to amend the Public Authorities Law by
adding a new Section, Section 354-a, which will require the New York
state Thruway Authority to discontinue and remove the Yonkers toll plaza
located on the New York State Thruway either completely or for
passenger cars only, and
WHEREAS, in recent years we have seen how the removal of the
Spring Valley toll plaza has aided in the flow of passenger car traffic
through this area, and
WHEREAS, with approximately the same amount of traffic passing
through the Yonkers toll plaza, this area is experiencing the same traffic
impediments and delays that were experienced prior to the discontinuation
and removal of the Spring Valley toll plaza, and
WHEREAS, by facilitating travel between lower Westchester
County and Rockland County, in addition to removing the impediment to
the flow of traffic and, thereby, aiding residents in both Counties, the
removal of the Yonkers toll plaza will undoubtedly have a positive impact
not only on the Austin Avenue shopping complex in Yonkers, but also on
the Palisades Mall in West Nyack, and
WHEREAS, to accomplish this, A10299 sponsored by
Assemblyman Spano and S3181 sponsored by Senator Stewart-Cousins,
is supported by the Yonkers City Council.
BE IT FURTHER RESOLVED, that the Council requests the
passage of said legislation and, further requests that Governor Paterson,
upon his review, sign the measure into law, and
BE IT FURTHER RESOLVED, that the City Clerk is hereby directed
to forward a duly certified copy of this Home Rule Message to the New
York State Legislature to each member of the Yonkers Delegation.

6. BY COUNCIL PRESIDENT LESNICK, MAJORITY LEADER ANNABI,
MINORITY LEADER McLAUGHLIN, COUNCILMEMBERS McDOW,
GRONOWSKI, AND BARBATO:
WHEREAS, the City of New York currently utilizes “Red
Light Cameras” as a means of traffic control and enforcement
within the City of New York and also creates a civil liability against
the owners of those cars photographed by the “Red Light
Cameras”; and
WHEREAS, this arrangement has proven to be very
successful in New York City as a means of traffic control and public
safety; and
WHEREAS, the City of Yonkers proposes a different method
to control traffic at intersections, by implementing a demonstration
program imposing monetary liability on vehicle owners for failure of
an operator thereof to comply with traffic- control indications in the
City; such program shall empower the City to install and operate
traffic–control signal photo-monitoring devices at intersections,
such program to be repealed three years after it goes into effect;
and
WHEREAS, Senator Andrea Stewart-Cousins and
Assemblyman Spano, have introduced Assembly Bill A.11117 and
S. 7083, an act which will amend the various State Laws to allow
the City of Yonkers to implement a program imposing monetary
liability upon vehicle owners for failure to comply with traffic control
indicators in the City of Yonkers and to empower the City of
Yonkers to install and operate traffic-control signal photo-monitoring
devices at intersections.
NOW THEREFORE, BE IT RESOLVED that the City
Council of the City of Yonkers hereby declares that the
enactment of A.11117 and S.7083 to amend various State Laws
to implement a program to empower the City of Yonkers to
install and operate traffic-control signal photo-monitoring
devices at intersections and to impose monetary liability upon
vehicle owners for failure to comply with the law, is in the best
interests of the City and is essential to improving the City’s

WHEREAS, Detention Officers are Peace Officers who supervise
and maintain order in Yonkers Penal holding facilities, and
WHEREAS, while Detention Officers in Yonkers complete tasks
similar to what Police Officers complete in other municipalities, they do not
have similar protections when it comes to on-the-job injury and disability,
and
WHEREAS, New York State Bill Numbers A03171 (Pretlow) and
S8330 (Cousins) would grant Detention Officers parity with other law
enforcement agencies for hazards and injuries that they experience while
performing their duties, and
WHEREAS, this legislation allows for the payment of the full
amount of salary or wages to a Detention Officer during an on-the-job
disability, medical treatment and/or hospital stay, and
WHEREAS, this legislation was previously forwarded to the New
York State Legislature from the Yonkers City Council in September 2007,
but without a corresponding Senate sponsor number, which was recently
released as S8330 (Cousins)
NOW, THEREFORE BE IT RESOLVED, that the City Council
hereby resubmits this Home Rule Message to the New York State
Legislature in support of New York State Assembly Bill number A03171
(Pretlow) and Senate Bill number S8330 (Cousins).
BE IT FURTHER RESOLVED, that the City Clerk is directed to
forward certified copies of this Home Rule Message to the Yonkers

WHEREAS, Untermyer Performing Arts Council has asked that

award (including both combat and non -combat awards) in the order of
precedence of U.S. military decorations; and
WHEREAS, Lt. Col. Walter D. Powers had previously served his
state and country for his entire life, including active duty in Iraqi, and
WHEREAS, Lt. Col. Walter D. Powers, is a member of the U.S.
Marine Corps and a veteran of Iraqi War; and
WHEREAS, Lt. Col. Walter D. Powers, served as Information
Officer of the U.S. Marine Corps from January 2007 thru December 2007;
and
WHEREAS, Lt. Col. Walter D. Powers, as an Information Officer,
received the Bronze Star Medal on May 26th, 2008; and

I am a citizen of New Rochelle deeply concerned with the Industrial Development Agency's recent decision to grant Cappelli Enterprises a substantial tax abatement/PILOT. This tax break is explicitly for the costs of reconfiguring New Roc City for retail use. Who is minding the store? Who's job is it to scrutinize these sweet deals?

Facts Missing From SFC Public Hearing: Letter in the Journal News

At Wednesday's public hearing on Yonkers' downtown development, representatives of community organizations advocated that the City Council commit ASAP to the downtown development project. They espoused the claimed benefits; however, did they mention the immediate additional general operating and debt liability cost that the taxpayers will have to pay over the next several years? Did they they say how long it will take before the new development projects will generate enough revenue to offset the additional municipal general and capital expenses? They did not mention that the council is aware it will have to seek more taxes from the average Yonkers resident this year and in each of the following years.

Please be advised that a Real Estate Committee Meeting has been scheduled for Tuesday, May 6, 2008 at 7:00 PM in the Council Chambers, City Hall, 4th Floor.


The following items will be on the Agenda:

1. Lead Agency requests that its consultant’s make themselves available for a briefing on substantive issues for the proposed SFC redevelopment project including but not limited to: Height, Density, Affordable Housing, Historic Preservation, the Day-lighting of the Saw Mill River, Parks and Open Space, and relationship to the Sugar Plant.

2. Any additional items that may properly come before this Committee.

We ask the Administration to please have the appropriate Commissioners/Departments Heads/Directors or their representatives attend the meeting so they can address issues relating to their departments.

Community Services Committee Meeting tonight in the Yonkers Ceremonial Courtroom at 6:00pm

There will be a Community Services Committee Meeting Wednesday, April 30, 2008 at 6pm in Ceremonial Courtroom, 4th Floor City Hall regarding recent alleged gang activity at the Glenwood Station Power Plant. By copy of this email, I am asking that the Administration send representatives from the Buildings and Police Departments to this meeting to discuss this issue. Ken Capolino of K.
